电子商务中消费者后悔权问题的研究

【摘要】:电子商务作为一种新的经济交易方式,对人们的工作和生活的影响越来越深远,一方面其具有“三全优势”即“全方位”、“全天候”和“全球性”的优势,另一方面由于电子商务具有快捷、方便、高效和成本低的特点,因此受到许多消费者和商家的喜爱,从而影响着人们的生活和工作。电子商务与传统商务有着本质的区别,电子商务最大的特点就是具有虚拟性,这使得消费者与商家之间不必当面进行议价、交易,这也导致了消费者对交易商品的服务、质量等很难有一个更准确地把握。所以,在一定程度上,电子商务的交易模式给消费者增加了相应的交易风险,容易引起消费者和商家的纠纷和矛盾。而网上购物具有跨地域消费的特点,导致消费者维权之困难。纵观国外先进的立法经验,后悔权制度是维护消费者权益的一项重要制度,后悔权制度的存在,不仅体现了民法的意思自治、公平正义、诚实信用原则的本质,也反映了国家对消费者权益保护问题的政策倾斜。对处于弱势地位的消费者合法权益的保护,后悔权制度的出现,无疑具有“雪中送炭”的价值。2014年3月15日新的《消费者权益保护法》生效后,尽管有条款规制了消费者的后悔权,但该条款太过于原则化,在具体操作与实际应用上还存在诸多问题。为了保障消费者后悔权制度的实施,笔者认为有必要构建消费者反悔权制度的具体内容。本文明确了后悔权制度的适用范围、起算时间、行使期限等。同时还借鉴了国外的立法经验和司法实践,建立了消费者专门机构和相应的制度来配合协调,为电子商务后悔权制度在我国的完善提供了一定的参考价值。
[Abstract]:As a new way of economic transaction, E-commerce has more and more far-reaching influence on people's work and life. On the one hand, it has the advantages of "all-around", "all-weather" and "global". On the other hand, because of the characteristics of fast, convenient, efficient and low cost, E-commerce is loved by many consumers and merchants, which affects people's life and work. Electronic commerce and traditional commerce have the essential difference, the biggest characteristic of electronic commerce is that it is fictitious, which makes it unnecessary for consumers and merchants to negotiate and trade in person, which also leads to the service of consumers to traded goods. Quality is difficult to have a more accurate grasp. Therefore, to a certain extent, the transaction mode of electronic commerce increases the corresponding transaction risk to consumers and easily causes disputes and contradictions between consumers and merchants. Online shopping has the characteristics of cross-regional consumption, leading to consumer rights difficulties. Throughout the advanced legislative experience of foreign countries, regret right system is an important system to safeguard the rights and interests of consumers. The existence of regret right system not only embodies the essence of the principle of autonomy of will, fairness and justice of civil law, and the principle of good faith. It also reflects the policy preference of the state on the protection of consumer rights and interests. The protection of the legitimate rights and interests of consumers in a weak position, and the emergence of the right of regret system, undoubtedly have the value of "giving a helping hand in time" .After the new Law on the Protection of Consumer Rights and interests came into effect on March 15, 2014, Although there is a clause that regulates consumers' right of regret, it is too principled, and there are still many problems in concrete operation and practical application. In order to ensure the implementation of consumer right of regret, I think it is necessary to construct the specific content of consumer right of repentance. This paper clarifies the scope of application, starting time, duration of exercise of the right of regret system. At the same time, it also draws lessons from the foreign legislative experience and judicial practice, establishes the consumer specialized organization and the corresponding system to coordinate, has provided the certain reference value for the e-commerce regret right system in our country consummation.
