网购消费者知情权保护研究
[Abstract]:With the improvement of our country's economic development level and the acceleration of the construction process of the society ruled by law, we pay more and more attention to the protection of the consumers' rights and make specific provisions on the consumers' rights, in which the consumers' right to know is an important part. At present, online shopping and other emerging trading behaviors have sprung up, and the scale of transactions has expanded rapidly, and has become a new favorite of people because of its high efficiency and speed. However, because of its non-realistic transaction characteristics, consumers are vulnerable to infringement of their rights in online shopping. In view of the increasing amount of e-commerce network transactions, there is a tendency to exceed the traditional consumption mode, which accounts for more and more proportion in the total consumption. Therefore, in the legal practice, how to play the leading role of the law to promote the healthy development of the network consumer industry, to protect the legitimate rights and interests of consumers has become an important issue in our research. This paper is divided into four parts, the first part is the definition of concept, that is, to elaborate the concept and characteristics of network consumption, and then clarify the specific meaning of the right to know of network consumers, and at the same time to compare the right to know of network consumption and the right to know of ordinary consumption. In the following article to explore the protection of the right to know of online shopping consumers to do a good foundation analysis. The second part mainly expounds the current situation of the protection of network consumers' right to know in our country, combing the main categories of consumers' right to know infringed, such as false commodity information, uncertain after-sales service provided by merchants and false credit degree of businesses. Then, the causes of these problems are analyzed, and the main reason of the problems is the lack of legislation, administrative supervision and judicature in the protection of online shopping in our country. A clear understanding of the current situation is of great significance for us to put forward reasonable legislation and law enforcement proposals. The third part mainly introduces the protection of Internet consumers' right to know in the European Union, the United States, Japan, South Korea and other countries, through the introduction of the information disclosure of online shopping operators in the above-mentioned countries, and no reason to return goods within a certain period of time. By comparing the advanced experiences of foreign major developed countries and regions in the protection of network consumers' right to know, it is helpful to put forward some suggestions on how to protect the right to know of online shopping consumers in our country. The fourth part is about the problem of consumer's right to know in our country's online shopping mentioned above. According to the successful overseas practice, the author puts forward how to solve the problem of infringing the consumer's right to know. It is hoped that consumers' right to know in network shopping can be protected from the aspects of perfecting the connotation of network right to know, clarifying the subject of responsibility and the scope of responsibility, perfecting the unimpeded protection mechanism, and so on.
