论我国出口管制法律体系的重构——基于“稀土案”的思考

【摘要】：我国为保护稀土等自然资源而采取的出口限制措施,在WTO体制下面临困境。为满足国家利益的刚性需求,我国应跳出利用WTO例外条款进行抗辩的法律困局,改变制度依赖路径,在履行国际法律义务的同时以国家安全为立法目标,重构出口管制法律体系,包括:制定《出口管制法》,整合出口管制清单、提升其全面性和技术性,加强促进出口管制遵守的制度建设,以及谋求加入多边出口管制机制,以推动区域性出口管制机制的发展。
[Abstract]:China's export restriction measures to protect natural resources such as rare earths are facing difficulties under the WTO system.In order to meet the rigid demand of national interests, our country should jump out of the legal dilemma of using WTO exception clause to defend, change the path of system dependence, and take national security as the legislative goal while fulfilling the international legal obligations.The restructuring of the export control legal system, including the enactment of the Export Control Act, the consolidation of export control lists, the enhancement of their comprehensiveness and technicality, the strengthening of institutional development to promote compliance with export controls, and the pursuit of accession to multilateral export control mechanisms,To promote the development of regional export control mechanism.
