我国转基因食品安全监管制度研究

【摘要】:现今社会,伴随着人们物质生活的极大丰富,餐桌上的转基因食品种类越来越多。转基因食品对于绝大多数人而言,仍旧是一个陌生的名词和领域。由于人们崇尚绿色环保健康的生活方式,对于自身健康和高品质生活方式的向往,转基因食品的安全性问题也逐渐引起人们的关注。社会经济的进步和发展离不开人类,而粮食却又是人类维持生命体征的物质基础。从这个意义上讲,转基因食品的监管制度可以说是目前社会事物监管的重中之重。作为生物科技成果的转基因食品具有强大的生命力,被许多国家作为解决食物问题的救命稻草。固然转基因食品出现的日子距今并非很短暂,但国际社会从没有休止过对转基因食品的安全性争辩,想要完全了解它并不是一朝一夕的事情。关乎转基因食品安全隐患的问题,我们要至始至终提高警惕。人言道瑕不掩瑜,转基因食品并非洪水猛兽,它的发展和推广势在必行。我们不仅仅要知道它、适应它,还要安全的、合理的、有效的进行监管,从而造福于人类社会。 本篇论文共分五章内容。开篇第一章主要论述了转基因食品的概念、种类,转基因食品的产生与发展状况以及公众对转基因食品的认知三方面的内容。第二章着重分析我国转基因食品的安全性问题及其特征,在这个基础上引出转基因食品安全监管的必要性分析。论文第三章在介绍我国有关转基因食品的法律法规的基础上,分析我国对转基因食品安全监管过程中存在的诸多问题。主要存在两大方面问题,一是立法层面的监管法规缺陷,二是现行的转基因食品安全监管制度存在缺陷。第四章主要从监管原则、监管主体和具有典型性的监管制度三方面介绍美国、欧盟、日本的监管制度,从其经验和教训中得出符合我国国情的启示。论文最后一章重点论述我国转基因食品安全监管的思路及对策。在这部分提出:要补充完善监管的基本原则;构建以政府监管为主导,行业协会自律和消费者协会监督为补充的互动协作的监管模式;细化和强化具体的监管举措。同时要保障转基因食品安全监管的实施卓有成效,还必须加大惩罚性赔偿的力度和强化企业的经济信用责任制度。
[Abstract]:Nowadays, with the abundance of people's material life, there are more and more kinds of genetically modified foods on the table. GM food is still a strange term and domain for most people. As people advocate green and healthy lifestyle and yearn for their own health and high quality lifestyle, the safety of genetically modified food has gradually attracted people's attention. The progress and development of social economy can not be separated from human beings, and grain is the material basis of human vital signs. In this sense, GM food regulatory system can be said to be the most important social supervision. Genetically modified foods (GMF), as biotechnological achievements, have strong vitality and have been used by many countries as the lifeline to solve food problems. Although GM food is not a very short time ago, the international community has never stopped arguing about the safety of GM food, and it is not an overnight thing to fully understand it. Concerning the problem of GM food safety risk, we should be vigilant from the beginning to the end. People say flaws, GM food is not a monster, it is imperative to develop and promote. We need not only to know it, to adapt to it, but also to regulate safely, reasonably and effectively for the benefit of human society. This paper is divided into five chapters. The first chapter mainly discusses the concept, category, production and development of GMF and public cognition of GMF. The second chapter focuses on the analysis of the safety problems and characteristics of transgenic food in China, and then leads to the necessity of the safety supervision of GM food. On the basis of introducing the laws and regulations of genetically modified food in China, the third chapter analyzes the problems existing in the process of safety supervision of genetically modified food in China. There are two major problems, one is the defects of the legislation and the other is the defects of the current regulatory system of GM food safety. The fourth chapter mainly introduces the supervision system of the United States, the European Union and Japan from three aspects: the principle of supervision, the subject of supervision and the typical supervision system, and draws the enlightenment from its experience and lessons in accordance with the national conditions of our country. The last chapter focuses on the thoughts and countermeasures of GM food safety supervision in China. In this part: to supplement the basic principles of regulation; to build a regulatory model with government regulation as the leading industry association self-discipline and consumer association supervision as a supplement; to refine and strengthen the specific regulatory measures. At the same time, in order to ensure the effective implementation of the safety supervision of genetically modified food, we must strengthen the punitive damages and strengthen the economic credit responsibility system of enterprises.
