【摘要】:随着我国经济的发展和金融体系的不断完善,金融市场化程度日益提高,商业银行信用卡业务和服务日益多样化,满足了人民群众对金融产品创新的需求,对个人诚信领域、社会消费和银行信用卡产业发展都起了重要的推动作用。 商业银行信用卡业务作为一种无抵押担保方式的信用放款业务,在银行业务中属于高风险银行业务,业务各层面的诚信观念、相应的风险防范体系和行业内部管理能力是该项业务顺利开展的重要前提。近几年,商业银行信用卡业务规模快速增长,而各商业银行对于信用卡各层面的诚信管理尚不成熟,导致银行信用卡业务出现因诚信缺失而引发相关业务问题。本文通过对商业银行系统业务数据、失信违法惩处案例的研究分析,认为现有商业银行信用卡业务中某些持卡人、商户、银行内部员工诚信意识淡薄是诱发失信行为发生的基础;而商业银行对于内部员工管理不严,内部诚信体制不健全,给某些员工失信行为留下了业务漏洞;当前我国社会诚信体系建设及相关立法机制不健全,也使得银行信用卡业务发展缺少必要的制度依据和行为准则。 基于对商业银行系统业务数据及失信违法惩处案例的分析,借鉴美国银行信用卡业务的经验,对解决我国商业银行信用卡业务诚信问题提出全面加强制度规范和技术规范建设的思路。首先,建立不想为的预防机制。加强诚信教育,在商业银行内部建立诚信文化理念,并在银行信用卡行业内部建立诚信自律机制,健全社会风险防范体系和风险管理能力。其次,建立不能为的监管机制。加强商业银行诚信管理,严控发卡诚信审核关,加强贷后诚信控制,完善商户诚信数据库加大社会舆论监督力度。再次建立不敢为的惩戒机制。最后应当建立相关的法律法规,失信黑名单制度。
[Abstract]:With the development of our economy and the continuous improvement of financial system, the degree of financial marketization is increasing, the commercial bank credit card business and services are increasingly diversified, to meet the people's demand for financial product innovation. In the field of personal integrity, social consumption and the development of bank credit card industry have played an important role. Commercial bank credit card business as an unsecured way of credit lending business, in the banking business belongs to high-risk banking business, business at all levels of the concept of good faith. The corresponding risk prevention system and industry internal management ability is an important prerequisite for the smooth development of the business. In recent years, the scale of credit card business of commercial banks has grown rapidly. However, the credit card management of all levels of commercial banks is not mature, leading to credit card business due to lack of integrity and lead to related business problems. This paper through the commercial banking system business data. Based on the analysis of the cases of dishonesty and punishment, it is considered that some credit card holders, merchants and employees in banks are the basis for the occurrence of discredit behavior. But the commercial bank is not strict to the internal staff management, the internal good faith system is not perfect, has left the service loophole to some staff discredit behavior; At present, the construction of social credit system and the related legislative mechanism are not perfect, which makes the development of bank credit card business lack of necessary system basis and code of conduct. Based on the analysis of the business data of commercial bank system and the punishment of breach of trust, the author draws lessons from the experience of credit card business of American bank. To solve the problem of credit card business integrity of commercial banks in China put forward a comprehensive strengthening of institutional norms and technical norms of the train of thought. First of all the establishment of prevention mechanisms do not want to strengthen the integrity of education. In the commercial banks to establish the concept of integrity culture and credit card industry in the banking industry to establish integrity self-discipline mechanism to improve the social risk prevention system and risk management capabilities. Secondly. To strengthen the management of commercial banks' integrity, strictly control the examination of credit card issuance, and strengthen the credit control after lending. We should perfect the bank of good faith of merchants and strengthen the supervision of public opinion. Finally, we should establish the relevant laws and regulations and blacklist system.
