离岸金融业务研究及对上海自贸区的启示

【摘要】：离岸金融是全球经济一体化和金融自由化的产物,是现代国际金融的重要组成部分。离岸金融业务运作灵活、资金进出自由、政策环境宽松,使其具备了成本低、流动性高、竞争性强的优势,吸引着全球投资者和跨国资本,对所在地经济发展起到了积极作用。2013年9月上海自贸区挂牌成立,作为自贸区金融改革创新的重要内容,离岸金融业务引导国际资本流入,为有效利用巨额外汇储备探索路径,助力人民币国际化,对我国经济发展和金融体制改革具有重要意义。文章系统梳理了世界离岸金融的主要业务和创新发展,详细分析了离岸金融业务对所在国经济带来的正面、负面的影响以及世界主要离岸金融中心的业务运行情况。以发展模式、区位选择、政策环境、业务范围和交易主体为支撑,分析了离岸金融业务在这些方面的发展经验,以及国际监管机构在离岸银行业务、离岸保险业务、离岸证券业务的监管规则,和各国政府在市场准入、外汇管制等方面的监管经验。试图将这些原本松散的观点提升到规范和系统的理论研究层面。文章结合我国和上海自贸区的实际情况,借鉴世界离岸业务发展的成熟经验,认为上海自贸区适宜采取离岸外币业务有限渗透、离岸人民币业务内外分离并举的运行模式；随着自贸区离岸市场功能逐渐完善,离岸金融业务将在融资类产品、资金结算类产品、离岸私人银行业务、离岸中间业务等方面有很大的发展空间；金融监管当局需要在外汇管制、市场准入和风险管理方面改进监管办法、提高监管效力,最后对上海自贸区顺利开展离岸金融业务提出了政策建议。
[Abstract]:Offshore finance is the product of global economic integration and financial liberalization, and an important part of modern international finance. The flexible operation of offshore financial business, the free flow of capital and the loose policy environment have given it the advantages of low cost, high liquidity and strong competitiveness, attracting global investors and transnational capital. It has played a positive role in the local economic development. In September 2013, the Shanghai Free Trade Zone was set up as an important part of the financial reform and innovation of the Free Trade Zone. The offshore financial business led the international capital inflow and explored the path for the effective use of huge foreign exchange reserves. The internationalization of RMB is of great significance to China's economic development and financial system reform. This paper systematically reviews the main business and innovative development of offshore finance in the world, and analyzes in detail the positive and negative effects of offshore financial business on the economy of the host country, as well as the operation of the major offshore financial centres in the world. Based on the development model, location choice, policy environment, business scope and trading subject, this paper analyzes the development experience of offshore financial business, as well as international regulators' offshore banking business, offshore insurance business. Regulatory rules for offshore securities business, and governments' regulatory experience in market access, foreign exchange controls, etc. This paper attempts to elevate these loose views to the theoretical research level of norms and systems. Based on the actual situation of China and Shanghai Free Trade area and the mature experience of offshore business development in the world, this paper holds that Shanghai Free Trade Zone should adopt the operation mode of limited penetration of offshore foreign currency business and separation of offshore RMB business. With the improvement of offshore market function, offshore financial business will have great development space in financing products, fund settlement products, offshore private banking business, offshore intermediary business and so on. The financial regulatory authorities need to improve the supervision methods in the aspects of foreign exchange control, market access and risk management, and improve the effectiveness of supervision. Finally, the policy recommendations for the smooth development of offshore financial business in Shanghai Free Trade Zone are put forward.
