我国自然垄断产业的规制改革研究

【摘要】： 随着社会经济的发展，新的科学技术的出现，自然垄断产业发生了巨大的变革。其中很多业务已经不具备自然垄断的性质，而仍具有自然垄断性质的业务也不该像过去一样完全受到政府的规制。本文正是基于自然垄断产业的这种变化，以国外自然垄断产业的规制改革为蓝本，通过比较分析的方法，描述我国自然垄断产业的规制改革，以期改变目前自然垄断产业生产效率低、服务质量差和服务收费高的传统弊端。文章指出，对自然垄断产业中的非自然垄断性业务应放松规制，引入竞争，但前提必须是对其进行体制改革，以使其政企分开，，同时进行配套一体化改革，完善立法支持、避免过度竞争。对自然垄断性业务，运用激励性规制，包括价格上限规制、区域间比较竞争和特许投标竞争，使规制与竞争有效结合，实现有效竞争。为了更好的说明这一改革思路，本文还以铁路为例，进行规制改革的分析。
[Abstract]:With the development of social economy and the emergence of new science and technology, great changes have taken place in the natural monopoly industry. However, the business which still has the nature of natural monopoly should not be completely regulated by the government as in the past. This paper is based on the change of the natural monopoly industry, taking the regulation reform of the foreign natural monopoly industry as the blueprint, through the method of comparative analysis. This paper describes the regulation reform of natural monopoly industry in China in order to change the traditional malpractice of low production efficiency, poor service quality and high service charge in natural monopoly industry. The article points out that the unnatural monopoly business in the natural monopoly industry should be loosened to introduce competition, but the prerequisite must be to reform its system so as to separate the government from the enterprise, at the same time to carry on the supporting integration reform and perfect the legislative support. To avoid excessive competition, incentive regulation, including price cap regulation, regional comparative competition and franchise bidding competition are used to effectively combine regulation with competition. In order to better explain this idea, this paper takes railway as an example to analyze the regulation reform.
