治理研究的前沿:不完整和动态产权经济学

【摘要】:现存产权理论暗含的一些基本观点或假定(产权是完整的、可清晰界定的、稳定的以及经典产权类型可单纯存在)是不现实的,产权事实上经常是不完整、混合、模糊和动态的。因此,必须对产权问题和现存产权理论进行重新审视和评估。相关研究发现:在将产权情况划分为四种基本类型的前提下,相应有四种解决产权问题的基本策略,即维持提高型、默认改造型、支持提高型和清晰改造型;应将"产权有效"而非"产权清晰"作为产权安排和问题解决的核心;为了实现有效产权安排,还必须建立系统和分层的完整的产权制度体系。与建立在完整、单纯、清晰和静态产权基础上的传统产权经济学相对应,有必要建立和发展不完整、混合、模糊和动态的产权经济学。
[Abstract]:Some basic viewpoints or assumptions implicit in the existing theory of property rights (property rights are complete, clearly defined, stable, and classical types of property rights can simply exist) are unrealistic, and property rights are often incomplete and mixed. Fuzzy and dynamic. Therefore, we must re-examine and evaluate the problem of property rights and the existing theory of property rights. The related research found that: on the premise of dividing the property rights into four basic types, there are four basic strategies to solve the problem of property rights, that is, maintaining the improved type, the default type, the supporting type and the clear type; "effective property right" rather than "clear property right" should be regarded as the core of property right arrangement and problem solving, and in order to realize effective property right arrangement, it is necessary to establish a systematic and stratified and complete system of property right system. Corresponding to the traditional property economics based on integrity, simplicity, clarity and static property rights, it is necessary to establish and develop incomplete, mixed, fuzzy and dynamic property rights economics.
