从PPP视角检视李姓游客免门票行为的性质

【摘要】：老君山旅游开发有限公司是否可以以促销的目的、自主免去李姓游客的门票?在看似简单的问题背后,实际上隐藏着PPP的玄机。梳理公司的创办历史,借鉴德国法院的身份标准和功能标准,参照现行法律规范,我们得知作为公私合作出资设立的PPP组织,其行为和行政任务之间缺乏制度关联,公司享有经营自主权。面对民族的文化复兴,结合新近我国文化体制改革与立法的导向,照顾人民精神文化生活方面的行政任务在系列立法中缺位的现象值得关注。
[Abstract]:Can Laojun Mountain Tourism Development Co., Ltd. be able to free the ticket of tourist's surname with the purpose of promotion? Behind the seemingly simple question, it actually hides the mystery of PPP, combing the company's history, drawing on the identity standards and functional standards of the German court, referring to the current legal norms, and knowing that it is a public and private partnership. The establishment of PPP organization, the lack of institutional connection between its behavior and administrative tasks, and the company's management autonomy. Facing the cultural rejuvenation of the nation, combining the new cultural system reform and the guidance of legislation in our country, the absence of administrative tasks in the people's spiritual and cultural life in the series of legislation is worth paying attention to.
