巴马生态旅游可持续发展问题及法律对策研究

【摘要】：生态旅游在当今旅游业中已成为一个热点,受到各国政府的重视和关心,越来越多的人认为二十一世纪是生态旅游世纪,是未来旅游发展的方向。联合国将2002年定为“国际生态旅游年”,同年5月,世界生态旅游峰会在加拿大魁北克召开,大会发表了《魁北克生态旅游宣言》,旨在积极促进生态旅游发展,围绕主题年曾举办一系列区域性的生态旅游研讨和培训活动,生态旅游因此迅速崛起,成为旅游业中的热门。2009年,国家旅游局将宣传口号确定为“2009中国生态旅游年”,经过一年的宣传和努力,生态旅游更加深入人心。温家宝总理在政府工作报告特别提到：中国实施以人为本、全面、协调和可持续的科学发展观,需要大力发展循环经济。这是可持续发展理论在我国的具体化的实施举措,在旅游产业的发展中也要适应可持续发展的需要,实现旅游业的可持续发展。在众多的旅游可持续发展的探索模式中,生态旅游是目前影响范围最广的一种。 随着社会经济的发展和居民生活水平的提高,参与生态旅游活动、回归自然,欣赏自然已成为现代生活方式的一个重要特征。借此契机,巴马大力发展生态旅游业。巴马是著名的世界长寿之乡,蕴藏着丰富的生态旅游资源,具有发展生态旅游的优势。目前,巴马生态旅游的发展正在由开发阶段向管理阶段过渡的阶段,但由于生态旅游法制建设的滞后,现今的巴马生态旅游发展面临着很多问题。本文基于巴马发展生态旅游的现实背景,结合巴马发展生态旅游的情况,深入分析了巴马发展生态旅游所面临的问题,并提出具有针对性的法律对策,对巴马生态旅游的开发与管理研究进行了有益探索,目的在于对从法律角度实现巴马生态旅游可持续发展进行探讨,以期对巴马生态旅游可持续发展有所裨益。 本文研究方法主要采取两种方式,一是理论研究与实证研究相结合的方法。首先研究生态旅游的概念、可持续发展的概念、生态旅游旅游可持续发展的内涵与要求这些基本理论,在此基础上,以巴马生态旅游为案例进行实证研究。二是文献调查与实地调查相结合的方法。文献调查是在查询、整理和分析文献资料的基础上,明确研究问题的范围与框架。实地调查则是对巴马生态旅游发展中产生的各种经验和问题进行查证。文献调查与实地调查相结合,保证了本文的理论价值和实际应用价值。 本文在生态旅游的理论基础上对巴马开展生态旅游,实现生态旅游可持续发展的法制建设方面进行分析。全部内容共分为五个部分： 第一部分主要介绍生态旅游的概念,包括国内外对于生态旅游的定义。接着对生态旅游的理论基础——可持续发展理论进行论述,再阐述二者之间的联系,介绍生态旅游可持续发展的内涵和要求。 第二部分主要介绍国外生态旅游发展阶段与各国发展生态旅游模式选择。国外发展生态旅游的经验教训为巴马生态旅游可持续发展提供了有益借鉴。 第三部分分析巴马发展生态旅游的有利条件和必要性。说明巴马走生态旅游开发的道路是明智的抉择。 第四部分具体分析巴马在生态旅游可持续发展中出现的问题。 第五部分在可持续发展思想的指导下,针对出现的问题提出有建设性的法律对策。 本文将以可持续发展思想为指导,在综合分析生态旅游相关理论和实践的基础上,对巴马生态旅游开发和管理中出现的问题进行分析,重点关注生态旅游法制建设方面出现的问题,并提出有针对性的法律建议,为巴马生态旅游可持续发展提供一个新的思路,为促进巴马地区的环境效益、经济效益和社会效益的协调发展增添理论依据。
