我国农村宅基地制度变迁研究

【摘要】：本文搭建了一个路径依赖和制度变迁理论分析框架,并以此为基础分析了新中国成立以来不同历史阶段农村宅基地制度的形成和变迁动因,研究发现我国农村宅基地制度经历了从农民私有制下自由流转到计划经济下的限制流转、改革开放初期的宽松流转,再到当前的限制流转四个阶段。这其中公有制意识形态的确立、弱势松散的农民群体和复杂的国内外形势一起推动农村宅基地用益物权被不断弱化,农民逐渐沦为最大利益受损者。虽然目前存在制度外收益的诱惑,但地方政府利益集团的巩固、制度变迁成本的增加,以及农民群体的势弱,使农村宅基地依然面临流转限制的制度锁定困境。未来较为可行的农村宅基地变迁路径为中央政府推动下的强制性制度变迁,形成改革共识,建立代表农民权益的经济组织,给予地方政府利益补偿,严控流转风险。
[Abstract]:This paper sets up a theoretical analysis framework of path dependence and institutional change, and based on this framework, analyzes the formation and changes of rural homestead system in different historical stages since the founding of New China. The study found that the rural homestead system in China has experienced the free circulation from the private ownership of farmers to the restricted circulation under the planned economy, and the loose circulation in the early stage of reform and opening up. The establishment of public ownership ideology, the weak and loose group of farmers and the complex situation at home and abroad promote the weakening of rural homestead usufruct right. Although there is the temptation of out-of-system income at present, the consolidation of local government interest groups, the increase of the cost of institutional change, and the weakness of peasant groups, In the future, the more feasible path of rural homestead transition is the compulsory institutional change promoted by the central government, forming a consensus on reform and establishing economic organizations representing the rights and interests of farmers. Give local government benefit compensation, strictly control circulation risk.
