生态公益林区划视角下的林农权益保障问题研究

【摘要】：进入新世纪,我国的集体林权制度改革已进入了可持续发展的阶段,既需要兼顾生态利益,也需要推动经济发展。尤其是伴随着林农主体意识的增强,生态公益林的区划中林农权益保护的问题就显得尤为重要。但在实践中,往往由于对公益林界定、种类认识有偏差或补偿措施不到位等,在一定程度上导致对林农权益保护的不足,从而造成林业生态价值、社会价值的缺失。要解决此问题,需要秉持可持续发展的思路,不仅重视公益林在维护生态建设方面的作用,也不能忽视林农利益的保护。通过健全法律法规、拓宽权利实习途径、完善补偿机制等手段破除林权制度中的不合理因素,最终实现生态价值与经济效益的双赢。本文结构上为五个部分:第一部分问题的提出,分析了生态公益林的研究背景和现状,以及完善生态公益林建设的可能性,引出本文研究的问题。第二部分对生态公益林区划进行概述,重点分析了我国生态公益林区划的性质和存在问题。本文的论点认为,我国生态公益林区划属于管制性征收的性质。第三部分介绍了生态公益林区划与林农权益保障之间的矛盾。通过分析产生矛盾的原因引出林农权益保障的不足之处,并进一步论述了充分实现林农权益保障的理论和现实基础。第四部分为如何实现生态公益林视角下的林农权益保障提供了建议。主要从三个层次进行阐述:完善相关的法律法规、完善生态补偿制度和林农保障机制、保障林农的四项具体权益。第五部分总结。
[Abstract]:In the new century, the reform of collective forest right system in China has entered the stage of sustainable development, which not only needs to give consideration to ecological interests, but also to promote economic development.Especially with the strengthening of the main body consciousness of forest farmers, the protection of forest farmers' rights and interests in the division of ecological public forest is particularly important.However, in practice, because of the definition of public welfare forest, the deviation of category understanding or the lack of compensation measures, it leads to insufficient protection of forest farmers' rights and interests to a certain extent, resulting in the lack of ecological value and social value of forestry.In order to solve this problem, it is necessary to maintain the idea of sustainable development, not only to attach importance to the role of public welfare forest in maintaining ecological construction, but also not to ignore the protection of forest farmers' interests.Through perfecting the laws and regulations, widening the practice way of right, perfecting the compensation mechanism and so on, the unreasonable factors in the forest property right system can be eliminated, and the win-win situation of ecological value and economic benefit will be realized finally.The structure of this paper is divided into five parts: the first part of the question put forward, analyzed the research background and present situation of ecological public welfare forest, as well as the possibility of perfecting ecological public welfare forest construction, lead to the problem of this paper.In the second part, the author summarizes the division of ecological public welfare forest, and analyzes the nature and existing problems of ecological public welfare forest regionalization in China.This paper argues that the division of ecological public welfare forest in China belongs to the nature of regulatory expropriation.The third part introduces the contradiction between the division of ecological public welfare forest and the protection of forest farmers' rights and interests.Based on the analysis of the causes of the contradictions, the deficiency of the protection of forest farmers' rights and interests is introduced, and the theoretical and practical basis for the full realization of the protection of forest farmers' rights and interests is further discussed.The fourth part provides suggestions on how to realize the protection of forest farmers' rights and interests from the perspective of ecological public welfare forest.It is mainly expounded from three levels: perfecting the relevant laws and regulations, perfecting the ecological compensation system and the forest farmers' security mechanism, and protecting the four specific rights and interests of the forest farmers.The fifth part summarizes.
