农户土地承包经营权抵押风险及其防范化解案例分析

【摘要】:十八届三中全会“赋予农民对土地承包经营权担保抵押权能”的提出,从国家的政策层面上放开了农户土地承包经营权的抵押。农户土地承包经营权抵押作为农地流转的重要形式,是最富研究意义的课题。承包经营权抵押既能提供农业发展所需的资金,又能促进土地流转,对发展规模化农业、提高土地利用效率具有重大意义。在寻求农村发展困境出路的过程中,我国不少地区开展了土地承包经营权抵押试点,如福建明溪县、四川崇州县、江苏太仓等地。然而轰轰烈烈的土地承包经营权抵押实践创新背后,风险重重。法律政策之间的冲突、市场的不完善等问题逐渐在试点显现出来,提供资金融通的金融机构的不积极参与,以及还未完全暴露出来的承包经营权抵押违约带来的纠纷也使得承包经营权抵押的推行举步维艰。及时发现土地承包经营权抵押的风险并对风险防范化解,以使承包经营权抵押顺利推行成为现阶段研究的重要问题。本文通过对取得一定成效的典型试点——福建明溪、四川崇州和江苏太仓的土地承包经营权抵押情况的分析,从国家法律政策、金融监管、市场交易三个层面揭示风险因素。结合试点地区的土地承包经营权抵押的经验,本文提出了风险防范化解的建议,即完善土地承包经营权抵押的司法解释、完善金融监管制度、建立农地抵押登记系统、构建土地金融保险制度、建立土地银行,从而保证农户土地承包经营权抵押的顺利开展。
[Abstract]:The third Plenary session of the 18th CPC Central Committee put forward the idea of giving farmers the ability to guarantee the mortgage of the land contract management right, which liberalized the mortgage of the land contractual management right of the farmers from the national policy level. As an important form of farmland circulation, land contract management right mortgage is the most significant research topic. The mortgage of contractual management right can not only provide the funds needed for agricultural development, but also promote the circulation of land, which is of great significance to the development of large-scale agriculture and the improvement of land use efficiency. In the process of finding a way out of the predicament of rural development, many areas of our country have carried out land contract management right mortgage pilot projects, such as Minxi County in Fujian Province, Chongzhou County in Sichuan Province, Taicang County in Jiangsu Province and so on. However, the vigorous land contract management right mortgage innovation behind the risk. Conflicts between laws and policies, market imperfections and other problems have gradually emerged in the pilot projects, and financial institutions that provide financing have not been actively involved. And not yet fully exposed the contractual management rights mortgage default disputes also make the implementation of contractual management rights mortgage difficult. It is an important problem to find out the risk of land contract management right mortgage and to prevent and resolve the risk in order to make the contract management right mortgage carry out smoothly. Based on the analysis of some typical pilot projects in Minxi, Chongzhou and Taicang, Jiangsu Province, this paper reveals the risk factors from three aspects: national legal policy, financial supervision and market transaction. Combined with the experience of the land contract management right mortgage in the pilot area, this paper puts forward some suggestions to prevent and resolve the risk, that is, to perfect the judicial interpretation of the land contract management right mortgage, to perfect the financial supervision system, and to establish the farmland mortgage registration system. The system of land finance and insurance should be set up, and the land bank should be set up to guarantee the smooth development of the mortgage of land contract management right.
