甘肃省环县农地流转的用途管制研究

【摘要】：农业生产以土地为其核心与根本,土地是发展社会经济的前提与基础,也就是说,土地问题与我国社会经济的稳定和安全有着直接相关性,当前我国土地资源极为紧张的情况下,农村土地用途管制的实行一方面是现阶段社会发展形势所提出的要求,同时也是我国社会健康、平稳发展的要求。保护环境资源和发展经济并非天然冲突,通过正确发挥体制的作用,可以实现两者的互利互补与彼此协调。所以对农地流转过程当中的用途性质进行管制,符合我国环境保护的要求,符合当前我国经济社会发展实际。文章通过文献研究法,实地调查法等研究方法,以甘肃省环县为研究对象,分析了甘肃省环县农地流转土地用途性质改变的现状、风险和对策。首先文章概述了当前甘肃省环县农地流转的现状。文章认为,随着甘肃省环县经济社会的快速发展,农村土地流转的面积显著增加,在一定程度上促进了农村经济社会的发展,促进了农业的产业化和规模化。其次文章分析了当前甘肃省环县农地流转用途性质发生改变的现状。文章研究认为,甘肃省环县在农村土地流转过程当中,农地流转用途性质发生改变的情况屡见不鲜。具体来说,农地转变为建设用地的情况较为多见。由于甘肃省环县近些年来大力实施工业强县的政策方针,为了平衡工业经济发展用地不足的情况,甘肃省环县近些年来在农地流转当中,大部分耕地转为建设用地,农地流转的用途性质发生显著改变。第三,文章分析了甘肃省环县农地流转用途性质发生改变的风险。文章通过风险识别的方法,从农民风险,生态风险,粮食风险,经济风险,社会风险5个角度,分析了甘肃省环县农地流转,用途性质发生改变可能存在的风险。并且利用专家咨询和模糊数学评价的方法,对甘肃省环县农村土地用途性质发生改变的风险进行评价,实际评价结果显示,甘肃省环县农地流转,用途性质发生改变的风险为中等,在长期的范围之内不利于甘肃省环县经济社会的发展。第四,文章分析了甘肃省环县农地流转用途性质管制的价值,问题和对策。甘肃省环县实行农地流转,用途性质管制,有利于防范经济社会发展的风险,促进生态环境的改善和农业的发展。当前甘肃省环县农地流转用途性质管制还存在着制度不健全,法律不完善等多种问题。需要从制度上加以完善,并且完善相关的法律法规,促进甘肃省农地流转的管制效率的提升。
[Abstract]:Agricultural production takes land as its core and foundation, and land is the prerequisite and foundation for the development of social economy, that is, the land problem is directly related to the stability and security of China's social economy. At present, land resources in our country are very tight, the implementation of land use control in rural areas is not only the demand of the present social development situation, but also the requirement of healthy and steady development of our society. Protecting environmental resources and developing economy are not natural conflicts. Therefore, the regulation of the nature of use in the process of agricultural land transfer accords with the requirements of environmental protection in our country, and accords with the reality of economic and social development in our country at present. Based on the methods of literature research and field investigation, this paper analyzes the present situation, risks and countermeasures of the change of the nature of land use in the annulus county of Gansu Province. First of all, the paper summarizes the current situation of agricultural land transfer in Huanxian County, Gansu Province. The paper holds that with the rapid development of economy and society in Huanxian County of Gansu Province, the area of rural land circulation has increased significantly, which to a certain extent has promoted the development of rural economy and society, and promoted the industrialization and scale of agriculture. Secondly, the paper analyzes the current situation of the change in the nature of farmland circulation in Huanxian County, Gansu Province. In the process of rural land transfer in Huanxian county of Gansu Province, the change of the nature of farmland circulation is common. To be specific, the situation that farmland transforms into construction land is more see. In order to balance the shortage of land for industrial economic development, in recent years, in order to balance the shortage of land for industrial economic development, most of the cultivated land has been converted into construction land during the agricultural land circulation in Huanxian County, Gansu Province, which has vigorously implemented the policy of strong industrial counties in recent years. Through the method of risk identification, this paper analyzes the possible risks of agricultural land circulation in Huanxian County of Gansu Province from the five angles of farmers' risk, ecological risk, grain risk, economic risk and social risk. Using the methods of expert consultation and fuzzy mathematics evaluation, this paper evaluates the risk of the change in the nature of rural land use in Huanxian County, Gansu Province. The actual evaluation results show that the rural land circulation in Huanxian County of Gansu Province, The risk of changing the nature of use is medium, which is not conducive to the economic and social development of Huanxian County in Gansu Province in the long term. Fourth, the paper analyzes the value, problems and countermeasures of the nature control of farmland circulation in Huanxian County, Gansu Province. The circulation of agricultural land and the control of the nature of use are beneficial to prevent the risk of economic and social development and to promote the improvement of ecological environment and the development of agriculture. At present, there are still some problems in the regulation of the nature of farmland circulation in Huanxian County, Gansu Province, such as imperfect system, imperfect laws and so on. We need to perfect the system and improve the relevant laws and regulations to promote the efficiency of rural land transfer in Gansu Province.
