城镇化进程中失地农民利益保障制度研究

【摘要】：目前,我国正处于城镇化快速发展的重要阶段,在这个过程中大量的农用土地被征用,祖祖辈辈依靠土地谋生的农民在失去了赖以生存的土地之后变成了失地农民。随着我国城镇化进程的不断发展,失地农民这一群体的数量必将变得越来越多。随之而来也产生了许多问题,失地农民被征用的土地怎样得到合理补偿、失地农民在被征用土地后如何进行合理安置、相关征地制度如何被规范等问题不仅会影响到失地农民的切身利益和“三农”问题的解决,而且还影响到社会主义和谐社会的构建。因为以上的原因,我们在现实中要正确处理好失地农民的补偿问题,这样人民群众的生产生活水平才会不断得到提高,社会经济才会健康有序发展。因此,地方政府因为城镇化发展征用了农民的土地之后,一定要对被征地农民进行合理的及时的补偿,本着以人为本的原则将被征地的农民的补偿安置好处理好。失地农民为城镇化的建设做出了巨大牺牲,祖祖辈辈赖以生存的土地被政府征用了,而且地方政府在具体的征地执行的过程中,有可能会伤害到一部分失地农民的切身权益。地方政府在这个时候就要对失地农民的损失进行合理及时的补偿。但是从目前我国的具体情况来看,在地方政府实际的征地补偿的过程中,还存在着诸多的问题。我国现在的针对征用土地所颁布的政策,一般情况下是政府通过发布行政命令来代替市场的运作,所以在具体的操作过程中间,政府在征地过程中往往带有强制色彩。由于地方政府在征地的过程中,出现了对被征地农民补偿不合理不及时以及补偿费用不足等情况,这些情况的发生,实际上可以看做是被征地农民的合法权益被地方政府侵犯,农民土地在被地方政府征收之后生活水平受到影响看,甚至因为征地生活陷入困顿之中。当前我国农村的社会保障制度还不健全,那些没有被纳入社会保障范围之内的失地农民很有可能因为征地之后不合理的补偿导致生活的贫困,在这样的情况下,容易引起一些社会矛盾,影响到社会的长治久安。当前顺利推进城镇化建设进程,维持社会稳定大局和长治久安的关键就是合理地对失地农民被征用土地和受损情况进行补偿。地方政府在这样的一个过程中间,自身要扮演什么角色,以什么样的方式给予失地农民补偿,补偿的标准又是多少,这些问题对于推荐城镇化的建设都具有重大的现实意义。在解决失地农民合法利益过程中,通过研究失地农民利益保障制度,不仅是我国当前在推进城镇化建设中必须解决的重大课题,也是我国在构建社会主义和谐社会的过程中必须解决的重大课题。本文立足于我国当前城镇化的进程,对于失地农民受损的合法利益补偿问题进行了分析,阐述了在我国当前城镇化稳步推进的前提下,各地纷纷征用农民手中的土地,失地农民大量出现的现实情况。与此同时,地方政府在处理失地农民受损的合法利益时,却因为一些主观原因和一些客观原因导致了补偿缺失的情况。本文通过分析上述主观和客观原因,得出要想从根本上解决失地农民的合法权益补偿问题还在于完善我国的征地制度和被征土地的补偿制度。只有将征地制度和被征土地的补偿制度这两个重要制度进行了完善,才能够将失地农民被征土地补偿问题解决好处理好,才能够进一步推动我国城镇化的建设。因此,本文提出要解决好农民合法权益的补偿问题,就是要以失地农民利益为中心建立健全相关的征地补偿相关制度。通过研究当前我国城镇化进程中,农民合法权益的补偿问题,本文认为关键在于要加强失地农民被征土地补偿制度的建设,更深层次的,还需要进一步完善土地产权制度,以保障失地农民的合法利益。此外,完善农村社会保障制度以及赋予失地农民相关权力也是确保失地农民实现合法权益的重要途径。
[Abstract]:At present, China is at an important stage of rapid development of urbanization. In this process, a large number of agricultural land is expropriated. The peasants who have relied on land for livelihood have become landless farmers after losing their land for survival. With the continuous development of the urbanization process in China, the number of land lost farmers will become more and more the more. The more problems come with it, and many problems arise. How can the land expropriated by the landless farmers get the reasonable compensation, how the land lost farmers are properly resettled after the land expropriated, and how to regulate the land requisition system will not only affect the vital interests of the landless peasants and the "three rural" problems, but also affect the society. Because of the above reasons, we should correctly handle the problem of compensation for the landless farmers in reality, so that the people's production and living standards will be continuously improved and the social economy will develop healthily and orderly. Therefore, the local government must have the farmers' land because of the town development. A reasonable and timely compensation for the land expropriated farmers will be made and the compensation and resettlement of the peasants who are land expropriated are well handled in accordance with the principle of "people-oriented". The landless peasants have made great sacrifices for the construction of the urbanization, and the land which has been depended on for generations has been expropriated by the government, and the local government is likely to be in the process of carrying out the specific land expropriation. The local government should make a reasonable and timely compensation for the loss of land lost farmers at this time. However, from the current situation of our country, there are still many problems in the process of the local government's actual land expropriation compensation. In general, the government will replace the operation of the market by issuing administrative orders, so in the middle of the specific operation process, the government often has a compulsive color in the process of land expropriation. Because of the local government's land expropriation, the situation of unreasonable compensation and insufficient compensation for the land requisition and the insufficient compensation cost appeared in the process of land expropriation. In fact, it can be seen that the legitimate rights and interests of the land expropriated farmers are infringed by the local government. The living standards of the farmers' land are affected by the local government, even because the land expropriation is trapped. The current social security system in the rural areas is not perfect, those are not included in the scope of social security. The landless peasants are likely to cause the poverty of life because of the unreasonable compensation after the land expropriation. In this case, it is easy to cause some social contradictions and affect the long-term stability of the society. The key to the smooth promotion of the process of urbanization, the maintenance of social stability and the Changzhi long an is the reasonable land expropriation of land lost farmers. In this process, the local government should play the role of the local government, and what kind of way to compensate the landless farmers and how much the compensation standard is. These problems are of great realistic meaning to the construction of the recommended urbanization. The study of the protection system for the interests of land lost farmers is not only a major issue to be solved in the construction of urbanization in China, but also a major task to be solved in the process of building a harmonious socialist society in China. This article is based on the process of urbanization in our country and the compensation for the legal interests of the lost peasants. On the basis of the analysis, the actual situation of land lost in the hands of farmers and a large number of landless peasants were expropriated on the premise of the steady advancement of the current urbanization in China. At the same time, the local government had caused the lack of compensation because of some subjective reasons and some objective reasons in dealing with the legitimate interests of the damaged peasants. By analyzing the subjective and objective reasons above, this paper draws a conclusion that the problem of the compensation for the legitimate rights and interests of the landless peasants is still to improve the system of land expropriation and the compensation system of the land. Only by perfecting the two important systems of the system of land expropriation and the compensation system of the land, can the peasants lose their land. If the problem of land compensation is solved well, it can further promote the construction of urbanization in China. Therefore, this paper proposes to solve the problem of compensation for the legitimate rights and interests of farmers, which is to establish and improve the related system of compensation for land expropriation with the interests of land lost farmers as the center. The key to the compensation of rights and interests is to strengthen the construction of the land compensation system for land lost farmers, and further improve the system of land property right in order to protect the legitimate interests of the landless peasants. In addition, the improvement of the rural social security system and the related power to the landless peasants is also to ensure the land lost farmers. An important way to present legitimate rights and interests.
