农村集体土地确权登记问题研究

【摘要】:农村集体土地确权登记包括集体土地所有权、集体建设用地使用权、农村宅基地使用权、农村承包土地经营权等各类集体土地权利的确定登记工作。农村集体土地的确权登记工作是国家全面推进农村产权制度改革工作的重要基础,对增强农村发展活力、加速农村社会经济发展、保护农民合法产权,推动集体土地科学利用、合法流转等方面均具有重要意义。近年来农村集体土地确权理论不断发展,确权登记发证实践工作的要求不断提高,党的十七届三中全会、十八大报告,国家"十二五"规划以及2010年、2011年、2013年中央一号文件均对农村土地确权登记发证工作提出了新的部署和要求,要求充分利用已有的第二次全国土地调查成果,对农村每宗土地的权属状况全面查清,并建立健全城乡一体化地籍数据库及信息管理系统,为逐步建立权能明确、产权明晰、流转顺畅、权益保障、严格规范、分配合理的农村集体土地产权制度,深化农村土地使用制度改革提供依据。基于农村土地确权发证工作的实际现状、研究背景和发展需求,本文拟依托河北省唐山市农村集体土地确权登记工作实践,重点探讨分析农村集体建设用地使用权、宅基地使用权确权登记工作的主要技术方法及流程、权籍调查及测量中的关键问题与对策,提出农村集体土地确权登记发证工作的相关建议与对策,以期为我国农村集体土地确权登记发证工作提供理论支撑和实践经验。
[Abstract]:The registration of rural collective land right includes collective land ownership, collective construction land use right, rural homestead use right, rural contracted land management right and other collective land rights. The registration of the rural collective land is an important foundation for the country to promote the reform of the rural property rights system in an all-round way. It can enhance the vitality of rural development, accelerate the development of rural society and economy, protect the legitimate property rights of farmers, and promote the scientific utilization of collective land. Legal circulation and other aspects are of great significance. In recent years, the theory of confirming the right of collective land in rural areas has been continuously developed, and the requirements for the practice of registration and issuance of the right of confirmation have been constantly raised. The third Plenary session of the 17th CPC Central Committee, the report of the 18th National Congress, The 12th Five-Year Plan of the State and the Central documents No. 1 of 2010, 2011 and 2013 all put forward new plans and requirements for the registration and issuance of rural land certification rights, requiring the full use of the existing results of the second National Land Survey. To investigate the status of ownership of each rural land in an all-round way, and to establish and improve the integrated cadastral database and information management system of urban and rural areas, in order to gradually establish clear powers, clear property rights, smooth circulation, protection of rights and interests, strict standardization, Rational distribution of rural collective land property system, deepening the reform of rural land use system to provide the basis. Based on the actual situation, research background and development demand of rural land certification, this paper focuses on the analysis of rural collective construction land use right based on the practice of rural collective land ownership registration in Tangshan City, Hebei Province. The main technical methods and processes of the registration of the right to the use of the homestead, the key problems and countermeasures in the investigation and measurement of the right to use the land, and the relevant suggestions and countermeasures for the registration and issuance of the right to confirm the right to the use of the rural collective land are put forward. In order to provide theoretical support and practical experience for the registration and certification of rural collective land ownership.
