湖南省土地合作社土地流转问题的研究

【摘要】：土地合作社是一种新型的经济组织,是在坚持现有农村家庭联产承包制度不变的情况下,统一经营管理农村土地,扩大了我国农业生产的规模。本文从实际情况出发,针对土地承包经营权流转问题进行合理分析阐述,以期为我国土地合作社的研究发展提供相关的理论基础。首先,本文全面的考察了湖南省土地合作社土地流转的现状。通过对人们对土地流转的意愿情况进行调研,从调查结果的数据分析中可知土地合作社土地流转的过程中存在的主要问题有参与土地流转的农户少、政府的行为失范,农民的利益没有得到保障、农业企业的发展困难以及土地流转市场机制发育不完善。其次,对导致土地流转过程中出现弊端的原因进行了分析。结果发现引起上述问题的主要原因有：法律法规对土地合作社土地流转方式限制过多、农村土地承包经营权登记制度不完善、土地承包经营权流转的监督主体缺位以及交易中介服务体系缺乏。最后,对完善我国土地合作社流转问题提出一些建议：第一,统筹城乡发展,营造土地流转良好环境。第二,建立健全土地承包经营权流转市场。第三,政府部门要在土地流转中做好规范和引导。
[Abstract]:The land cooperative is a new type of economic organization. Under the condition of insisting on the existing rural household contract system, the land is managed in a unified way and the scale of agricultural production has been expanded in our country. Based on the actual situation, this paper makes a reasonable analysis and exposition on the transfer of the land contract management right in order to provide the relevant theoretical basis for the research and development of the land cooperative in our country. First of all, this paper investigates the current situation of land circulation of land cooperatives in Hunan Province. Through the investigation of people's willingness to land transfer, the main problems in the process of land transfer of land cooperatives are the small number of farmers involved in land circulation and the abnormal behavior of the government, according to the data analysis of the survey results. The interests of farmers are not guaranteed, the development of agricultural enterprises is difficult and the market mechanism of land circulation is not perfect. Secondly, it analyzes the causes of the malpractice in the process of land circulation. The results show that the main causes of the above problems are: the laws and regulations on the land transfer mode of land cooperatives too many restrictions, rural land contractual management rights registration system is not perfect, The supervision subject of land contract management right circulation is absent and the transaction intermediary service system is lacking. Finally, some suggestions are put forward to improve the circulation of land cooperatives in China: first, to coordinate the development of urban and rural areas and to create a good environment for land circulation. Second, establish and perfect the land contract management right circulation market. Third, government departments should do a good job in land circulation and guidance.
