涉外农村土地承包经营权关系探析

【摘要】：长期以来,我国农村生产力水平和农业科技发展水平比较低,农民依靠土地生活但是普遍收入不高。在这种情况下,农民们尤其是青壮年劳动力纷纷选择外出打工,农村劳动力的短板使得“谁来种地”成为社会关注的焦点。随着农村产权交易市场的逐步开放,农户承包土地经营权等8项农村产权通过交易平台进行交易,不少外国人携带雄厚的资本和技术进入农村产权交易市场,他们承包农村土地,并采用先进的农业科技、实行规模化经营。本文第一章介绍了中国和外国对于涉外农村土地承包经营权的立法规定和权能,第二章深入探析了涉外农村土地承包经营权关系,由于我国目前对此缺乏明确的立法,外国民事主体的行为缺乏引导和约束,针对这些问题,在第三章笔者提出了自己的建议,希望对完善《农村土地承包法》贡献绵薄之力。
[Abstract]:For a long time, the level of rural productivity and the development of agricultural science and technology in our country have been relatively low, and farmers rely on land for living, but the general income is not high. In this case, the peasants, especially the young and middle-aged labor force, choose to go out to work one after another, and the shortage of rural labor force makes "who cultivates the land" to become the focus of the society. With the gradual opening of the rural property trading market, 8 rural property rights, such as farmers' contracted land management rights, are traded through trading platforms, and many foreigners bring abundant capital and technology into the rural property rights trading market. They contract rural land, and use advanced agricultural technology, scale operation. The first chapter of this paper introduces the legislative provisions and power of China and foreign countries on the right of contracted management of foreign rural land, the second chapter deeply analyzes the relationship of contractual management right of foreign rural land, because of the lack of clear legislation on it in our country at present. The behavior of foreign civil subjects is short of guidance and restraint. In view of these problems, the author puts forward his own suggestions in the third chapter, hoping to make a modest contribution to the perfection of the Rural Land contract Law.
