唐山市农村宅基地退出机制研究

【摘要】：唐山市城镇化、工业化的快速发展造成城市建设用地需求的剧增。但是,这与耕地红线的坚守和农村建设用地粗放利用的现状形成了突出的矛盾。农村宅基地承载着土地经济功能和一定的社会保障功能,是农村建设用地的重要组成部分,农村宅基地的有序退出可以大幅度缓解唐山市的人地矛盾,为唐山市的经济建设提供重要物质支撑。因此,唐山市急需建立切实可行的农村宅基地退出机制。通过问卷调查和实地访谈的方式,获取了唐山市农村宅基地退出工作的实施情况和农户对于宅基地退出的意愿信息。通过对调研结果的分析得出,目前唐山市农村宅基地退出过程中主要存在四个问题:第一,唐山市现行的农村宅基地的退出政策对农户宅基地退出意愿的激励作用较弱。第二,农村宅基地退出的土地用途不规范,违法、违规使用农村宅基地的现象时有发生,这严重扰乱了农村宅基地的退出工作。第三,在城乡“二元体制”下,农村人口的社会福利待遇与城市居民相差悬殊,农户对宅基地退出后的生活保障存在顾虑,往往不愿意配合宅基地退出工作。第四,农村宅基地的无序利用影响了村容村貌建设,农村宅基地退出的效果不理想。进一步,本研究通过文献分析法,分析总结现有文献;运用定量分析法借鉴国内外农地流转的先进经验。以西方产权理论和外部性理论为理论依据,结合唐山市农村宅基地退出过程中存在的问题,提出适合唐山市实际情况的农村宅基地退出机制建议。建议唐山市建立“四轮驱动”的农村宅基地退出机制,把农村宅基地退出的约束机制、激励机制、保障机制和配套机制相结合,以促进农村土地资源的整合,为统筹城乡建设用地资源服务。
[Abstract]:The rapid development of urbanization and industrialization in Tangshan City caused a sharp increase in the demand for urban construction land. However, this has formed an outstanding contradiction with the adherence to the red line of cultivated land and the present situation of extensive utilization of rural construction land. As an important part of the rural construction land, the rural homestead is carrying the land economic function and certain social security function. The orderly withdrawal of the rural homestead can greatly alleviate the contradiction between people and land in Tangshan City. Tangshan to provide important material support for economic construction. Therefore, Tangshan urgent need to establish a practical rural homestead withdrawal mechanism. By means of questionnaire survey and field interview, the author obtained the implementation of rural homestead withdrawal in Tangshan City and the information of farmers' willingness to withdraw from homestead. Through the analysis of the results of the investigation, it is concluded that there are four main problems in the process of rural homestead withdrawal in Tangshan. Firstly, the exiting policy of the rural homestead in Tangshan City has a weak incentive effect on the farmers' willingness to withdraw from the homestead. Second, the rural homestead withdrawal land use is not standardized, illegal, illegal use of rural homestead phenomenon occurs from time to time, which seriously disturbed the rural homestead withdrawal work. Thirdly, under the dualistic system of urban and rural areas, the social welfare treatment of rural population is far from that of urban residents, and farmers are worried about the life security after the homestead withdrawal, and often unwilling to cooperate with the homestead withdrawal work. Fourth, the disorderly use of rural homestead affects the construction of village appearance, and the effect of rural homestead withdrawal is not ideal. Further, this study through the literature analysis, analysis and summary of the existing literature, the use of quantitative analysis method to learn from the advanced experience of agricultural land transfer at home and abroad. Based on the western theory of property rights and the theory of externality, combined with the problems existing in the process of rural homestead withdrawal in Tangshan City, this paper puts forward some suggestions on the withdrawal mechanism of rural homestead suitable for the actual situation in Tangshan City. It is suggested that Tangshan should establish a "four-wheel drive" mechanism for the withdrawal of rural homestead, and combine the restraint mechanism, incentive mechanism, security mechanism and supporting mechanism of rural homestead withdrawal, in order to promote the integration of rural land resources.
