山西省扩权强县法律问题研究

【摘要】：近些年来,在我国经济体制转轨和社会转型的大背景之下,县域经济的发展可谓是成效卓著,与此同时,自上世纪80年代以来实施的“市管县”体制所造成的消极影响却日渐突出,并成为束缚县域经济发展的体制性因素。而“扩权强县”改革可以促进县域经济的快速与健康发展,因此,其逐渐成为理论界备受关注的话题,其具体改革实践也已然成为一个时代潮流。在山西省实施资源型经济转型改革试验中,山西省借鉴外省改革经验,以“先行先试”的政策为指引,开展了“扩权强县”改革的探索之路,并且已取得了一定的成效。但是,从法律角度来看,无论是基础理论还是法律实践均显得薄弱,因此,有必要加强研究。本文采用规范分析法和对比分析法对“扩权强县”和“市管县”“省直管县”予以了规范分析。采用文献分析法梳理了与“扩权强县”改革有关相的理论及改革实践。通过实证分析法分析了山西省扩权强县改革的现状,并以此提出了相应的法律对策。本文除引言和结论以外,共分为四个部分：第一部分概括地阐述了扩权强县改革的基本理论。在厘清“扩权强县”、“强县扩权”以及“省直管县”相关概念的基础上,界定了三者之间的关系。并以此分析了“扩权强县”改革的理论基础。第二部分从实证分析出发,对山西省“扩权强县”改革的具体事项予以经济法分析,明确了改革的积极效应。第三部分从法学视角出发,重点剖析了山西省“扩权强县”改革中存在的问题,并揭示了改革困境的原因。第四部分探讨了山西省“扩权强县”改革的法律对策。提出了对山西省“扩权强县”改革具体的法制对策。总之,本文通过对山西省“扩权强县”改革相关法律问题的探讨,从法律视角分析认为,山西省“扩权强县”改革应与山西省“综改试验区”形成互动,抓住“先行先试”这一良好机遇,将“扩权强县”改革的进行纳入法治轨道上来。
[Abstract]:In recent years, under the background of economic system transition and social transformation in our country, the development of county economy can be described as remarkable, at the same time, Since the 1980s, the negative influence caused by the "city governing county" system has become more and more prominent, and has become an institutional factor constraining the development of county economy. The reform of "expanding power and strengthening counties" can promote the rapid and healthy development of county economy. Therefore, it has gradually become a topic of great concern in the theoretical circle, and its specific reform practice has become a trend of the times. In the course of carrying out the reform experiment of resource-based economy in Shanxi Province, Shanxi Province used the experience of other provinces for reference, guided by the policy of "first try first", and carried out the exploration of the reform of "expanding power and strong counties", and has achieved certain results. However, from the legal point of view, both the basic theory and the legal practice are weak, so it is necessary to strengthen the research. In this paper, normative analysis and comparative analysis are used to analyze "expanding the power of strong counties" and "the cities and counties" and "the provinces directly in charge of counties" to carry out the normative analysis. This paper combs the theory and practice related to the reform of "expanding power and strong county" by literature analysis. This paper analyzes the current situation of the reform of the expanding and powerful counties in Shanxi Province by means of empirical analysis, and puts forward the corresponding legal countermeasures. In addition to the introduction and conclusion, this paper is divided into four parts: the first part generalizes the basic theory of expanding power and strengthening county reform. On the basis of clarifying the related concepts of "expanding power and strengthening county", "strong county expanding power" and "managing county directly by province", the relationship between them is defined. On this basis, it analyzes the theoretical basis of the reform of "expanding power and strengthening counties". In the second part, from the empirical analysis, the concrete items of the reform of "expanding power and strong counties" in Shanxi Province are analyzed by economic law, and the positive effect of the reform is clarified. The third part, from the angle of law, analyzes the problems existing in the reform of "expanding power and strong counties" in Shanxi Province, and reveals the reasons for the difficult situation of reform. The fourth part discusses the legal countermeasures of the reform of "expanding power and strong counties" in Shanxi Province. This paper puts forward specific legal countermeasures for the reform of "expanding power and strong counties" in Shanxi Province. In a word, through the discussion of the legal problems related to the reform of "expanding power and strong counties" in Shanxi Province, this paper analyzes from the legal perspective that the reform of "expanding and strengthening counties" in Shanxi Province should interact with the "comprehensive reform experimental area" of Shanxi Province. Seize the good opportunity of "try first" and bring the reform of "expanding power and strong counties" into the track of rule by law.
