【摘要】：三农问题一直是党和国家高度关注的焦点。如何在实际生活中尽可能的提高农民的生活水平,提高土地的利用效率,同时又保证国家基本制度的实施和土地政策的稳定；如何给予农民更多的生活保障,同时又实现土地资源的合理配置一直是颇为复杂的问题。土地信托流转制度似乎为解决这些问题提供了新的思路。然而我国现行《土地承包管理法》和《信托法》对土地信托流转的相关规定,如同大多数制度一样,随着经济的发展,呈现出很多不足。中共十八届三中全会通过的《决定》,确定了新一轮的土地制度改革。并提出要“鼓励和引导工商资本到农村发展适合企业化经营的现代种养业,向农业输入现代生产要素和经营模式”。这次土地制度的改革,说明了立法者对于农村土地流转的关注,发现了传统农村土地流转过程中的不足,为工商资本进入农村、参与农村土地流转提供了法律支持。为了进一步研究农村土地信托流转,笔者深入含山县进行实地调研,了解含山县土地信托流转的运行情况,包括土地信托流转的概念、土地信托流转的法律依据、土地信托流转的运行流程、土地信托流转在含山县的实际规模以及运行过程中所产生的优势。在通过直接访谈、掌握第一手资料的同时,笔者发现由于含山县土地信托流转制度缺乏丰富的经验以及开展时间较短,逐渐显现出一些问题,比如土地确权工作尚未完成、政府宏观调控与行政干预过多、缺乏统一的法律与制度保障、农民法律意识淡薄,维权手段不足、土地信托制度和配套措施不健全等。这些问题的存在不利于含山县土地信托流转制度的健康有序发展,因此本文试图结合《土地承包法》《信托法》以及安徽省含山县土地信托流转的实际案例,探讨我国农村土地信托流转制度在实践存在的一些共性问题,并从法律的角度提出自己的一些解决建议,希望对农村土地信托流转制度的完善能有一些微薄的作用。首先要明确土地信托流转过程中各方当事人的权利、义务；其次要规范土地信托流转的程序过程,健全我国有关土地信托流转方面的法律法规,使土地信托流转有法可依,有规可循。建立健全统一的土地信托监察人制度,完善政府职责。最后要加强法制建设,加大法律宣传,畅通行政救济、司法救济渠道,更好的保护农民利益。
[Abstract]:The issue of agriculture, rural areas and farmers has always been the focus of attention of the Party and the country. How to improve the living standards of farmers and improve the efficiency of land use as much as possible in real life. At the same time, to ensure the implementation of the basic national system and the stability of land policy; How to give farmers more life security. At the same time, the rational allocation of land resources has always been a very complicated problem. The land trust circulation system seems to provide a new way of thinking to solve these problems. However, the current Land contract Management Law and Trust Law in China. Relevant provisions on the circulation of land trusts. Like most systems, with the development of the economy, there are many deficiencies. A new round of land system reform has been determined, and it is proposed to "encourage and guide industrial and commercial capital to develop a modern farming and raising industry suitable for enterprise management in rural areas." Input modern factors of production and management mode to agriculture ". The reform of land system shows legislators' concern for rural land circulation and finds the shortcomings in the process of traditional rural land circulation. For the industrial and commercial capital to enter the countryside, participate in rural land transfer to provide legal support. In order to further study the rural land trust circulation, the author went deep into Hanshan County to carry out field research. To understand the operation of land trust circulation in Hanshan county, including the concept of land trust circulation, the legal basis of land trust circulation, and the operation process of land trust circulation. Land trust circulation in the actual scale of Hanshan County and the advantages of the operation process. Through direct interviews, grasp first-hand information at the same time. The author found that due to the lack of rich experience and short time of land trust transfer system in Hanshan County, some problems appeared gradually, such as the completion of land confirmation work, too much government macro-control and administrative intervention. Lack of unified legal and institutional protection, weak legal awareness of farmers, inadequate means of safeguarding rights. Land trust system and supporting measures are not perfect. These problems are not conducive to the healthy and orderly development of land trust circulation system in Hanshan County. Therefore, this paper attempts to combine "Land contract Law" and "Trust Law" and the actual case of land trust circulation in Hanshan County, Anhui Province, to explore some common problems existing in the practice of rural land trust transfer system in China. And from the perspective of the law to put forward some of their own solutions, hoping to improve the circulation of rural land trust system can have some modest role. First of all, it is necessary to clarify the rights of the parties in the process of land trust circulation. Obligations; Secondly, we should standardize the procedure of land trust circulation, perfect the laws and regulations of land trust circulation in our country, and make the land trust circulation have legal basis. It is necessary to establish a unified land trust supervisor system and perfect government duties. Finally, we should strengthen legal system construction, increase legal publicity, unblock administrative relief, judicial relief channels, and better protect the interests of farmers.
