【摘要】：在全球经济一体化的背景下,中国海外投资事业蓬勃发展,然而,我国海外投资保险的发展却十分滞后,构建与之相适的保险法律制度势在必行。海外投资保险法律制度是海外投资者母国为保护海外投资者的海外投资安全,弥补政治风险给其所带来损失的法律制度。20世纪50年代,海外投资保险法律制度在美国诞生,随后,日本、德国、澳大利亚等国家相继引入。我国海外投资保险制度的缺失,已经严重阻碍了我国企业全球化发展的步伐。本文的目的是在比较研究相关先进立法的基础上,对中国海外投资保险法律制度的建立,进行简要讨论,归纳并提出对我国海外投资保险立法的建议。本文主体内容共含四章：第一章：海外投资保险立法概况。本章首先对海外投资、政治风险、海外投资保险法律制度等概念进行界定,其次,就海外投资保险法律制度的历史发展情况进行阐述,为下文对海外投资保险立法的系统分析埋下伏笔。第二章：海外投资保险立法比较研究。本章从系统模式、保险人、被保险人、保险对象和承保范围等方面对美国、日本、德国三个国家的海外投资保险立法做一个系统的分析,希望为中国海外投资保险立法的完善提供一些参考。第三章：中国海外投资保险立法的现状及问题。介绍了中国海外投资保险立法的现状和存在的问题。第四章：中国海外投资保险立法的完善及建议。从保险制度的模式选择、保险人、被保险人的范围、保险对象、承保范围等方面提出了一些建议,以期对完善我国的海外投资保险立法有所裨益。
[Abstract]:In the context of global economic integration, China's overseas investment is booming, however, the development of China's overseas investment insurance is lagging behind. It is imperative to construct an appropriate legal system of insurance. The legal system of overseas investment insurance is the home country of overseas investors to protect the overseas investment safety of overseas investors. In 50s, the legal system of overseas investment insurance came into being in the United States, then Japan, Germany, Australia and other countries introduced it one after another. The lack of overseas investment insurance system in China has seriously hindered the pace of the globalization of enterprises in China. The purpose of this paper is to compare and study the relevant advanced legislation. This paper briefly discusses the establishment of the legal system of China's overseas investment insurance, summarizes and puts forward some suggestions on the legislation of China's overseas investment insurance. The main content of this paper consists of four chapters: Chapter one: the general situation of overseas investment insurance legislation. Firstly, this chapter defines the concepts of overseas investment, political risk, legal system of overseas investment insurance and so on. This paper expounds the historical development of the legal system of overseas investment insurance, which lays the groundwork for the systematic analysis of the legislation of overseas investment insurance. Chapter two: comparative study of overseas investment insurance legislation. This chapter analyzes the American and Japanese from the aspects of system model, insurer, insurant, insurance object and insurance coverage. This paper makes a systematic analysis on the legislation of overseas investment insurance in three countries of Germany, hoping to provide some references for the perfection of the legislation of overseas investment insurance in China. Chapter three: the current situation and problems of China's overseas investment insurance legislation. Chapter 4th: the perfection and suggestion of China's overseas investment insurance legislation. Some suggestions are put forward from the aspects of the mode selection of insurance system, the scope of the insurer, the insured, the object of insurance, the scope of insurance, and so on. In order to perfect our country's overseas investment insurance legislation has the benefit.
