【摘要】： 2007年10月温家宝总理在十七大政府工作报告中提出努力建设“资源节约型和环境友好型社会。”也就是说,经济的发展不能以牺牲环境为代价,必须建立在优化结构、提高效益、降低消耗和保护环境的基础之上。而怎样才能使国家在环境友好的情况下快速良性的发展经济,是环境法律学者面前的一大课题。尤其是当前我国的环境问题已非常严重,单纯运用环境行政管理手段已经不能解决环境污染问题,如何调动企业环境保护的积极性,让企业重新承担环境保护方面所肩负的社会责任成为理论研究的热点。资金是企业生存的关键,而信用贷款是企业获取资金的重要渠道,绿色信贷应运而生。运用经济学杠杆,刺激企业自主进行产业结构调整和污染防治,是环境经济政策中的重要组成部分之一,通过对企业融资的控制达到引导企业的目的。绿色信贷在我国实施的三年来,其法律困境已经严重的影响绿色信贷制度在我国环境保护中发挥更大的作用,所以,绿色信贷法律制度的完善十分必要。本文通过对绿色信贷一般理论的考察,界定我国绿色信贷法律制度的内涵,考察绿色信贷法律制度的历史发展,比较和借鉴国外相关环境信贷法律制度,对我国绿色信贷制度的实践状况和面临的法律困境进行分析,提出经济环境政策引导下我国绿色信贷法律制度完善的具体建议。文章的主要内容是:第一部分,课题的选题背景、研究内容和框架;第二部分,信贷的概念、信贷过程中的环境风险、绿色信贷的意义;第三部分,我国绿色信贷法律制度的内涵、绿色信贷法律制度的起源和发展、我国绿色信贷法律制度的必要性分析;第四部分,国外的绿色信贷法律实践、对我国的借鉴;第五部分,我国绿色信贷制度的实践、我国绿色信贷的法律困境;第六部分,完善绿色信贷法律制度的建议,也是全文的重点,包括绿色信贷的相关立法模式选择以及具体制度建议。
[Abstract]:In October 2007, Premier Wen Jiabao proposed to build a "resource-saving and environment-friendly society" in his report on the work of the 17th National Government. In other words, the development of economy should not be at the expense of the environment, but should be based on optimizing the structure, improving the efficiency, reducing the consumption and protecting the environment. And how to make the country develop economy quickly and benignly under the circumstance of environment friendly is a great subject for the environmental law scholars. In particular, the current environmental problems in our country have become very serious. The use of environmental administrative means alone can no longer solve the problem of environmental pollution. How to mobilize the enthusiasm of enterprises in environmental protection, It is a hot topic in theory to let enterprises bear the social responsibility of environmental protection. Capital is the key to the survival of enterprises, and credit loan is an important channel for enterprises to obtain funds. Green credit emerged as the times require. It is an important part of environmental economic policy to use economic lever to stimulate enterprises to adjust their industrial structure and prevent pollution independently. The aim of guiding enterprises is to control the financing of enterprises. Since the implementation of green credit in China for three years, its legal predicament has seriously affected the green credit system in environmental protection in China, so it is necessary to improve the legal system of green credit. Through the investigation of the general theory of green credit, this paper defines the connotation of the legal system of green credit in our country, examines the historical development of the legal system of green credit, compares and draws lessons from the relevant legal system of environmental credit in foreign countries. This paper analyzes the practice of green credit system in China and the legal dilemma it faces, and puts forward some concrete suggestions to perfect the legal system of green credit in China under the guidance of economic environment policy. The main contents of this paper are as follows: the first part, the background of the topic, the research content and framework; the second part, the concept of credit, the environmental risk in the credit process, the significance of green credit; the third part, The connotation of China's green credit legal system, the origin and development of green credit legal system, the necessity analysis of our country's green credit legal system; the fourth part, the foreign green credit legal practice, the reference to our country; the fifth part, The practice of green credit system in our country, the legal dilemma of green credit in our country; the sixth part, the suggestion of perfecting the legal system of green credit, is also the key point of this paper, including the choice of relevant legislative mode and the specific system suggestion of green credit.
