法律视角下的农村土地流转信托化研究

【摘要】：农村土地流转问题是我国的核心问题,该问题关系到农业发展质量与粮食安全。近年来,我国城镇化程度迅速提高的背景下,大批农民进城务工,出现了城乡差距日益扩大、农村土地经营效率低下、大量抛荒的现象,在深层次上反映出传统的土地流转方式已经难以适应规模化、集约化的农业生产要求。于是,土地流转方式的创新成为必然选择。我国许多地方自发开展了农村土地流转的信托化探索,信托制度的财产转移功能、财产独立性、信托的长期性和稳定性等特征能否有效地促进我国土地的集约化和规模化利用值得进一步的探讨和研究。本文主要从农村土地流转的改进目标、农村土地信托的法律要素的构成、我国开展的相关实践以及有待改进等方面进行分析,并给出笔者自己的合理化建议。具体可以分为以下几个部分：第一章介绍了将信托引入农村土地流转的大背景、国内外文献综述、研究思路和方法、研究的内容、创新与不足这四个方面进行了简要阐述：第二章对传统的土地流转方式各自的优势和缺陷进行了分析,并提出土地承包经营权的流转目标,进而引出土地流转方式的信托化；第三章从信托制度的起源、农村土地信托的内涵和农村土地信托的独特法律特征、委托人、受托人、受益人的权利义务以及农村土地信托的财产独立性等方面入手、论证将信托制度与农村土地流转相结合的可行性。第四章采用横向比较的研究方法、以农村土地信托在美国和日本的发展情况为研究对象,总结以美国、日本两种代表性强的模式各自的独特优势。从中探索对我国的相应领域的借鉴价值。第五章对我国农村土地信托的现状作了基本描述,对目前以信托方式开展农村土地流转的不同的基本运行原理进行比较,对各自的优缺点进行归纳总结。第六章指出我国处于萌芽阶段的农村土地信托实践中出现的问题和不足之处,对这些问题的形成原因和负面影响进行了分析。第七章着呢对前述问题从立法完善、交易机制构建、监管等几个方面提出笔者的合理化建议。结论部分对全文进行了简单的回顾和总结,并对本文未作论述或者论述不够的地方作了简单的说明。
[Abstract]:The issue of rural land circulation is the core problem in China, which is related to the quality of agricultural development and food security. In recent years, with the rapid development of urbanization in our country, a large number of peasants have entered the city to work, and the gap between urban and rural areas has been widening day by day, the efficiency of rural land management has been low, and a large number of abandoned. The deep level reflects the traditional land circulation way has already been difficult to adapt to the scale, the intensive agricultural production request. As a result, the innovation of land circulation has become an inevitable choice. Many places in our country have spontaneously carried out the trust exploration of rural land circulation, the property transfer function of trust system and the property independence. Whether the long-term and stability of trust can effectively promote the intensive and large-scale utilization of land in China is worthy of further discussion and study. The composition of the legal elements of the rural land trust, the relevant practice in China and the need for improvement are analyzed, and the author's own rationalization suggestions are given. Specific can be divided into the following parts: the first chapter introduces the trust into the rural land circulation background, domestic and foreign literature review, research ideas and methods, research content, Four aspects of innovation and deficiency are briefly expounded: chapter two analyzes the advantages and disadvantages of the traditional land transfer mode, and puts forward the transfer goal of the land contract management right, which leads to the trust of the land transfer mode; The third chapter starts with the origin of the trust system, the connotation of the rural land trust, the unique legal characteristics of the rural land trust, the rights and obligations of the trustor, the beneficiary and the property independence of the rural land trust. The fourth chapter uses the horizontal comparative research method, taking the development of rural land trust in the United States and Japan as the research object, summarizes the United States, The unique advantages of Japan's two representative models. The fifth chapter describes the current situation of rural land trust in China, and compares the different basic operating principles of rural land transfer in the form of trust. The sixth chapter points out the problems and deficiencies in the practice of rural land trust in the embryonic stage of our country. The reasons for the formation of these problems and their negative effects are analyzed. In the seventh chapter, uh, from the perspective of the legislative perfection and the construction of the transaction mechanism, In conclusion, the author makes a brief review and summary of the full text, and gives a brief explanation of the place that this paper has not discussed or discussed not enough.
