【摘要】:本文以城乡一体化的土地产权问题及其实施路径为分析主线,围绕城乡一体化发展,统筹分析农村土地产权制度改革中有关土地多重政治、经济、法律属性, “地票”制度的利弊得失等,针对上述分析范畴,分别循着发现问题、提出问题、分析问题、解决问题或者得出研究结论的逻辑思路进行了层次递进的制度分析和政策分析。本文内容共6章,分为三个部分。第一部分包括绪论和核心概念与理论基础,是全文的导入和铺垫。第一章,该部分做了文献综述,回顾了前人的研究成果,还简要介绍了本文的研究框架、技术路线、研究方法、研究的不足之处与可能的创新之处等。第二章,介绍了本研究所用到的核心概念,以及结构转化理论、人口迁移理论、人力资本投资理论、城市发展理论以及经济一体化理论等。第二部分包括第三章至第五章,是全文的正文部分。该部分紧扣城乡一体化的城乡土地产权并轨问题,围绕相关分析范畴,用了三章的篇幅,分别分析了城乡一体化体系中的宏观定位、土地产权并轨等存在的问题及其原因。第三章,针对城乡一体化成为国家战略的来龙去脉,它不是一个“要或不要”的问题,而是一个约束条件下把握启动时机的“或早或迟”的问题。此章还论述了城乡一体化体系的内在逻辑,包括:城乡一体化发展的显性标志和治本之道或曰隐性标志、目标分解的五个方面、需要重点解决六大问题,需要抓住“人、地、财”三大核心生产要素,以及系统推进中,战略在各层次政策组合中的互补性、重心选择以及执行层次各种尺度的把握,政策“误区”的规避,等等。第四章,主题是城乡土地产权并轨。土地问题十分复杂,城乡一体化能否顺利实现的“命门”也是土地。本章在分析城乡土地管理的现状基础上,提出了在进行农村土地产权制度改革的过程中需要遵循的基本原则,并指出不同地区在尝试农村产权制度改革时,一定要谋定而后动。第五章,主要分析了制约城乡一体化进程中城乡土地产权并轨的深层原因,主要体现在制度缺失、流转模式低效、二元体制、农户意识、监管缺失和社会保障体制不完善等方面。第三部涵盖第六章。第六章,总结全文并在分析结果的基础上提出可供参考的路径选择。本文得出的主要结论如下:土地问题十分复杂,一定要“谋定而后动”。土地是农村得天独厚的资源禀赋,是形成农村内生发展能力最现实的基本生产要素。土地是农民最重要的产权、资本和“等价物”。土地制度涉及国家政治与法律,与社会主义、国家性质、集体化、物权法等内容联系在一起。户籍制度、社会保障制度、公共服务提供等都要受土地产权制度的制约。成都和重庆等关于土地使用权和农民房屋所有权进入市场流动的先行先试,.能否经受得住一轮政策周期的检验,是否可持续等,下结论尚为时过早。
[Abstract]:This paper focuses on the integration of urban and rural land property rights and its implementation of the main line, around the development of urban and rural integration, the overall analysis of the reform of rural land property rights system related to land political, economic, legal attributes. The advantages and disadvantages of the "land ticket" system, in view of the above categories of analysis, respectively follow the discovery of problems, put forward problems, analysis of problems. The logical thinking of solving the problem or drawing the conclusion of the research has carried on the hierarchical progressive system analysis and the policy analysis. This article has 6 chapters, divides into three parts. The first part includes the introduction and the core concept and the theoretical foundation. The first chapter is a literature review, review of previous research results, but also a brief introduction of this research framework, technical routes, research methods. The second chapter introduces the core concepts used in this study, as well as structural transformation theory, population migration theory, human capital investment theory. Urban development theory and economic integration theory. The second part includes the third to 5th chapters, which is the text of the full text. This part is closely linked to the urban-rural integration of urban and rural land property rights. Around the relevant analysis category, three chapters are used to analyze the macro-positioning of urban-rural integration system, land property rights and other existing problems and their causes. Chapter three. In view of the fact that urban-rural integration has become a national strategy, it is not a question of "want or not". This chapter also discusses the internal logic of urban-rural integration system. Including: the dominant sign of urban-rural integration development and the way to cure the root cause or recessive sign, the five aspects of goal decomposition, need to focus on solving six major problems, need to grasp the "man, land, money" three core factors of production. And in the promotion of the system, the complementarity of the strategy in the policy mix at all levels, the choice of the center of gravity and the grasp of various scales at the executive level, the avoidance of the "erroneous zone" of the policy, etc., etc. The theme is the integration of urban and rural land property rights. The land problem is very complex, and whether the integration of urban and rural areas can be smoothly realized is also land. This chapter is based on the analysis of the current situation of urban and rural land management. This paper puts forward the basic principles to be followed in the process of the reform of the rural land property right system, and points out that when different regions try to reform the rural property right system, they must seek to make sure and then move on. 5th chapter. It mainly analyzes the deep reasons of restricting the integration of urban and rural land property rights in the process of urban and rural integration, mainly reflected in the lack of system, inefficient circulation mode, dual system, farmers' consciousness. The third part covers 6th chapters. 6th chapters. The main conclusions of this paper are as follows: the land problem is very complex. Land is the unique resource endowment in rural areas and the most realistic basic production factor to form the rural endogenous development ability. Land is the most important property right of farmers. Capital and "equivalent". Land system involves national politics and law, and links with socialism, national nature, collectivization, property law, etc. Household registration system, social security system. The provision of public services is restricted by the system of land property rights. Chengdu and Chongqing are the first to test land use rights and farmers' ownership of houses into the market, and whether they can withstand a round of policy cycles. It is too early to conclude whether it is sustainable or not.
