我国行政执法监督存在的问题和对策研究

【摘要】：在社会主义市场经济建设的进程中,随着弹性的行政管理职权不断扩张,行政执法已成为行政管理的重要组成部分，它通过刚性的制度约束和科学的执法理念，直接广泛地影响社会公共利益和人民群众的切身利益，同时也是导致和诱发社会矛盾纠纷、引发社会不和谐因素的主要原因。然而,目前我国现阶段行政执法状况,虽然比以往有很大的改善,但仍然存在很多问题,如有法不依,执法不严,违法不究等现象时有发生。这些现象的出现严重违背了社会主义法治的基本精神和根本要求,损害了人民群众的根本利益,也严重损害了党和人民政府的良好形象。因此，要大力规范现代行政执法理念，从制度、方法、政策等方面加强对行政执法行为的有效监督，努力构建科学规范、高效透明的执法监督机制，才是实现依法治国、依法行政的重要保障。作为依法行政的重要保障，行政执法监督起到了十分重要的作用，但是就当前时期我国的行政执法监督体制来看，还是有很多不健全的地方。突出表现在监督力量薄弱，监督理论缺失，制度设计不够完善等重要方面。强化行政执法监督，，是监督和规范行政执法机关公正执法、文明执法的前提，也是切实维护广大人民群众合法权益的重要手段，对全面建设法治社会、法治政府起到了重要的推动作用。本文中，笔者通过对当前我国行政执法监督中存在的问题进行归纳整理，并深入实际对工商、税务、质监、食品、卫生等相关行政执法部门进行调研，了解人民群众普遍关心的市场监管、税收制度、产品质量、食品安全等情况，对普遍存在的一些共性问题及特点进行分析，客观实际地提出适合解决这些问题的对策，并提出自己的看法。只有综合政治、经济、文化、法律等各个方面的研究成果，才能对实际探究有所裨益，只有从根源出发，才能分析出真正有益于我国社会主义法治建设，有益于人民大众的需求，这正是笔者写这篇论文的目的和意义所在。
[Abstract]:In the process of socialist market economy construction, with the continuous expansion of flexible administrative authority, administrative law enforcement has become an important part of administrative management. Directly and extensively affects the social public interests and the vital interests of the people, at the same time, it is also the main reason that causes and induces social contradictions and disputes, and causes social disharmony. However, the current situation of administrative law enforcement in our country, although there is a great improvement over the past, but there are still a lot of problems, such as the law does not abide by, law enforcement is not strict, illegal and other phenomena occur from time to time. These phenomena have seriously violated the basic spirit and basic requirements of socialist rule of law, damaged the fundamental interests of the masses of the people, and seriously damaged the good image of the party and the people's government. Therefore, it is necessary to standardize the concept of modern administrative law enforcement, strengthen the effective supervision of administrative law enforcement behavior from the aspects of system, method and policy, and strive to build a scientific and standardized, efficient and transparent law enforcement supervision mechanism, which is the only way to realize the rule of law. The important guarantee of administration by law. As an important guarantee of administration by law, the supervision of administrative law enforcement has played a very important role, but in the current period, there are still many imperfect places in our country's administrative law enforcement supervision system. Outstanding performance lies in the weak supervisory power, the lack of supervision theory, the imperfect design of the system and other important aspects. Strengthening the supervision of administrative law enforcement is the prerequisite for supervising and standardizing the impartial and civilized law enforcement of administrative law enforcement organs, and is also an important means to effectively safeguard the legitimate rights and interests of the broad masses of the people. The government under the rule of law has played an important role in promoting it. In this paper, the author summarizes and collates the existing problems in the supervision of administrative law enforcement in our country, and makes a thorough investigation on the relevant administrative law enforcement departments, such as industry and commerce, taxation, quality supervision, food, hygiene and so on. To understand the situation of market supervision, tax system, product quality and food safety that the masses are generally concerned about, and to analyze some common problems and characteristics that exist generally, and to put forward objectively and practically appropriate countermeasures to solve these problems. And put forward their own views. Only by synthesizing the research results of politics, economy, culture, law and so on, can we benefit the actual exploration, and only from the root, can we analyze the real benefits to the construction of the socialist rule of law in our country. This is the purpose and significance of writing this paper.
