自治立法中的民间规范研究——以黔东南州为例

【摘要】：根据国内现行法律规定,民族自治地方享有在特定事项上的立法权。以黔东南州现有法律法规为例,这些规范在类型上涵盖授权性、义务性和禁止性三种,内容上体现了当地民族在政治、经济和文化上的特色。这些民族自治地方的规范虽然在回应地方要求以及发展少数民族文化上有所建树,但不可避免的存在一些问题,如与地方法规的关系不明以及民间规范上升为法律法规的途径有所缺失。
[Abstract]:According to the current domestic laws, national autonomous areas enjoy legislative power in specific matters. Taking the existing laws and regulations of Qiandongnan Prefecture as an example, these norms cover three types: authorization, obligation and prohibition, which embody the political, economic and cultural characteristics of the local people. Although the norms of these autonomous areas have made some achievements in responding to local demands and developing the culture of ethnic minorities, there are inevitably some problems. If the relationship with local laws and regulations is unclear and folk norms become laws and regulations, there is a lack of ways.
