温州市滩涂围垦引发的渔民权益问题研究

【摘要】：改革开放以来，，温州渔业经济水平不断在提高。不过，因受当地资源条件的限制，现阶段温州渔业经济也遇到了很多困难。捕捞能力过剩导致渔业资源面临着非常严重的捕捞压力，很多传统渔业资源都面临着衰退；社会经济发展带来的各种海域污染、海洋工程建设及滩涂围填等，对海洋环境以及渔业资源都产生了非常恶劣的影响。此外，上述因素也在逐步降低温州渔民的基础性生产物质资源，温州市的生产空间也被日益挤压，渔民的渔业权益得不到法律的保护。最近几年，温州渔民经济增长比率相对较低，渔民和城镇居民之间的收入差距不断加大，个别渔区渔民甚至面临着返贫问题，渔区公共服务基础建设有待完善，渔民缺乏应有的社会保障，维护渔民权益问题日益成为构建温州市渔农村的重要内容。当前，如何切实有效的解决失海、失涂等渔民权益问题，合法合情合理的获得公共政策的有力支持和保障，成为温州市深化渔农村建设，推进城镇化建设方面需要进一步探讨的话题。本文基于我国滩涂围垦发展的视角，揭示了温州市滩涂围垦情况与温州沿海县市区滩涂围垦现状，从宏观层面分析了滩涂围垦对渔民权益的影响以及温州市滩涂围垦对渔民权益产生的影响，在国家、浙江省、温州市以及各沿海市县多角度诠释了有关滩涂围垦方面渔民权益保障的公共政策，指出了相关政策落实的落实情况及其存在的问题，并认为温州市委市政府要进一步落实国家以及省委省政府的相关政策规定，切实保障温州市渔业经济发展，维护渔民权益。
[Abstract]:Since the reform and opening up, Wenzhou fishery economic level is constantly improving. However, due to the constraints of local resources, Wenzhou fishery economy has also encountered a lot of difficulties. The overcapacity of fishing causes the fishery resources to face the very serious fishing pressure, many traditional fishery resources are facing the recession; The pollution of sea area, the construction of marine engineering and the reclamation of beach have had a very bad effect on the marine environment and fishery resources due to the development of social economy. In addition, the above factors are also gradually reducing Wenzhou fishermen's basic production material resources, Wenzhou City's production space is also increasingly squeezed, fishermen's fishing rights and interests can not be protected by law. In recent years, the economic growth rate of Wenzhou fishermen has been relatively low, the income gap between fishermen and urban residents has been widening, and individual fishermen in fishing areas are even facing the problem of returning to poverty, and the public service infrastructure in fishing areas needs to be improved. Fishermen lack due social security, and the protection of fishermen 'rights and interests has become an important content of constructing Wenzhou fishing countryside. At present, how to effectively solve the problems of fishermen's rights and interests, such as loss of the sea, loss of painting, and so on, so as to obtain legal and reasonable support and protection from public policies, has become the deepening of the construction of the fishing countryside in Wenzhou. To promote urbanization construction needs further discussion of the topic. Based on the development of tidal flat reclamation in China, this paper reveals the situation of tidal flat reclamation in Wenzhou and the current situation of tidal flat reclamation in coastal counties of Wenzhou. This paper analyzes the influence of tidal flat reclamation on fishermen 'rights and interests and the influence of beach reclamation on fishermen' rights and interests in Wenzhou City from the macro level. Wenzhou City and various coastal cities and counties interpret the public policy on the protection of fishermen's rights and interests in the area of beach reclamation, and point out the implementation of the relevant policies and their existing problems. It is considered that the Wenzhou municipal government should further implement the relevant policies and regulations of the state and the provincial government to ensure the development of fishery economy and safeguard the rights and interests of fishermen in Wenzhou.
