通过重大环境决策终身责任追究制度提升地方政府环境治理能力

【摘要】：多年环境问题的积累与环境群体性事件集中爆发,显示政府正在失去环境治理的权威,凸显政府环境治理能力不足。而地方政府环境治理中的重大环境决策终身责任追究制度就是通过让政府积极履行职责来重获信任、重树权威的重要方式。现有的问责制局限主要在对在任期间的领导问责,很少关注环境决策失误的终身责任追究。而事实上,重大决策终身责任追究在我国地方环境治理中,可以倒逼地方政府提升环境治理能力。因此,我国有必要在现有的行政问责的基础之上合理界定重大环境决策终身责任追究的范围和对象、明确重大决策追责标准、严格执行和遵守法定程序、明确重大环境决策终身追责时效、加强重大环境决策问责制度建设,将重大环境决策终身责任进一步制度化、规范化和法律化。
[Abstract]:The accumulation of environmental problems for many years and the concentrated outbreak of environmental mass incidents show that the government is losing the authority of environmental governance. Highlighting the inadequacy of the government's ability to govern the environment. And the system of lifelong accountability for major environmental decisions in local government environmental governance is to regain trust by enabling the government to actively perform its duties. The existing accountability system is limited mainly to the accountability of the leadership during the tenure, and little attention is paid to the lifelong responsibility for environmental decision-making mistakes. In fact, in our local environmental governance, the responsibility for major decision-making is investigated for life. Therefore, it is necessary for our country to reasonably define the scope and object of life-long responsibility for major environmental decision-making on the basis of the existing administrative accountability, and clarify the criteria for pursuing responsibility for major decisions. It is necessary to strictly enforce and abide by legal procedures, clarify the limitation of responsibility for major environmental decisions for life, strengthen the construction of accountability system for major environmental decisions, and further institutionalize, standardize and legalize the lifelong responsibility of major environmental decisions.
