生态文明建设背景下的我国环境教育立法构想

【摘要】：人类与环境的关系是环境教育的核心,而环境教育的本身是采用系统的教育方法进行的一项社会实践活动。其目的在于解决环境问题与社会可持续发展之间的矛盾；其任务在于增强全民的环境保护意识,并使其掌握必要的环保知识与技能。目前,国际社会普遍认为：转变公众的环境观念,提高公众的环境保护意识,是实现可持续发展的一个基础。因此,其必要性就得到了充分的体现,同时也是解决环境问题的必由之路。环境保护,教育为本。而环境教育的实施和顺利开展离不开法制的保障。纵观世界范围内那些先后制定了专门的环境教育法的国家和地区,都不同程度的促进了各国环境教育事业的发展,更有效地提高了公民的环保意识。如美国、日本、巴西等国家在环境教育立法方面的成就,值得我们认真的去分析研究与借鉴学习。与国外的情况相比较,我国的环境教育发展相对迟缓,环境教育立法实践尚处于初级阶段,发展明显落后,相关的环境教育的法律法规也只是散见于一些法律条文中,缺乏可操作性且极易流于形式。在当前呼吁建设社会主义生态文明,建设社会主义和谐社会的新形势下,面对严峻的环境问题,环境教育立法就显得刻不容缓,该法将有力保障环境教育的初期开展与远期完善。因此,个人认为有必要结合我国现阶段的基本国情,深入了解国内环境教育发展现状,并充分比较各国环境教育立法的特点,最终在此基础上,对我国环境教育专门立法做初步的构想,以此来保障环境教育在我国的顺利开展,进而在全社会形成一种“环境保护,从我做起”的良好氛围。
[Abstract]:The relationship between human beings and environment is the core of environmental education.Its purpose is to solve the contradiction between environmental problems and social sustainable development, and its task is to strengthen the awareness of environmental protection of the whole people and to make them master the necessary knowledge and skills of environmental protection.At present, the international community generally thinks that changing the public's concept of environment and raising the public's consciousness of environmental protection are the basis of realizing sustainable development.Therefore, its necessity has been fully embodied, and is also the only way to solve environmental problems.Environmental protection, education-oriented.The implementation and smooth development of environmental education can not be separated from the protection of the legal system.Throughout the world those countries and regions that have successively formulated a special environmental education law have promoted the development of environmental education in different countries to varying degrees and improved citizens' environmental awareness more effectively.Such as the United States, Japan, Brazil and other countries in environmental education legislation achievements, worthy of our serious analysis and study.Compared with the situation abroad, the development of environmental education in our country is relatively slow, the legislative practice of environmental education is still in the primary stage, the development is obviously backward, and the relevant laws and regulations of environmental education are only scattered in some laws and regulations.Lack of maneuverability and easy to become a mere formality.In the new situation of calling for the construction of socialist ecological civilization and building a harmonious socialist society, it is urgent to legislate on environmental education in the face of severe environmental problems.The law will be able to protect the initial development and long-term improvement of environmental education.Therefore, I think it is necessary to thoroughly understand the current situation of the development of environmental education in China, and to fully compare the characteristics of the environmental education legislation of various countries with the basic conditions of our country at the present stage. Finally, on this basis,In order to guarantee the smooth development of environmental education in our country, a good atmosphere of "environmental protection, start from me" is formed in the whole society.
