基于通航管理的海事执法风险评估研究

【摘要】：近年来，随着法治社会的不断推进，海事执法工作人员在执法过程中会遇到各种风险，这些风险如果不加以认识，会给海事部门的公信力造成一定的损失。因此，研究通航管理中海事执法风险因素，，并对海事执法进行风险评价，根据风险评价结果，海事机关可以针对性加强风险防范，这样有利于提高海事机关的执法效率，对海事机关提高公信力具有重要的意义。 本文首先阐述了通航管理中海事执法风险的特点，分析了通航管理中海事执法人员在执法过程中可能存在的各种风险因素，按照风险评估指标体系建立的基本原则，构建了通航管理中海事执法风险评价指标体系。 其次分析了风险评估中常用的几种评估方法及它们的优缺点。根据通航管理中海事执法风险因素既有模糊性，又具有灰色性，选择模糊综合评价和灰色系统相结合的灰色模糊综合评估方法，运用层次分析法确定各个风险因素指标的重要程度。灰色系统理论中运用的是白化权函数，并请评价专家依据一定的评估标准进行评分，得到评估指标的灰统计权向量。阐述了模糊灰色综合评估方法的原理和步骤，并详细描述了通航管理中海事执法风险的评价模型：确实风险指标体系、划分风险等级、确定评估灰类和白化权函数、专家打分得到灰色模糊权矩阵、确定各个风险指标权重、最后进行灰色模糊综合评判，得到通航管理中海事执法风险等级以及各个风险指标等级。 最后结合具体例子，运用灰色模糊综合评价模型进行综合评价，得到某海事局通航管理中海事执法风险的整体风险情况，分析评估结果，并根据风险评估结果提出相应的风险防范措施。
[Abstract]:In recent years, with the development of the society ruled by law, maritime law enforcement personnel will encounter various risks in the process of law enforcement. If these risks are not recognized, they will cause certain losses to the credibility of maritime departments. Therefore, the risk factors of maritime law enforcement in navigation management are studied, and the risk evaluation of maritime law enforcement is carried out. According to the result of risk evaluation, maritime authorities can strengthen risk prevention in order to improve the efficiency of maritime law enforcement. It is of great significance to enhance the credibility of maritime authorities. In this paper, firstly, the characteristics of maritime law enforcement risk in navigation management are expounded, and various risk factors that may exist in the course of maritime law enforcement are analyzed, and the basic principles of risk assessment index system are established. The risk evaluation index system of maritime law enforcement in navigation management is constructed. Secondly, it analyzes several methods of risk assessment and their advantages and disadvantages. According to the fact that the risk factors of maritime law enforcement in navigation management are both fuzzy and grey, the method of grey fuzzy comprehensive evaluation combined with grey system is chosen. Use analytic hierarchy process to determine the importance of each risk factor index. The whitening weight function is used in the grey system theory, and the evaluation expert is asked to score according to certain evaluation criteria, and the grey statistical weight vector of the evaluation index is obtained. This paper expounds the principle and steps of fuzzy grey comprehensive evaluation method, and describes in detail the evaluation model of maritime law enforcement risk in navigable management: the index system of real risk, the classification of risk, the determination of evaluation ash and whitening weight function. Experts score the grey fuzzy weight matrix and determine the weight of each risk index. Finally, the grey fuzzy comprehensive evaluation is carried out to get the maritime law enforcement risk grade and each risk index grade in navigation management. Finally, by using the grey fuzzy comprehensive evaluation model, the overall risk of maritime law enforcement risk in the navigation management of a maritime administration is obtained, and the evaluation results are analyzed. According to the results of risk assessment, the corresponding risk prevention measures are put forward.
