我国金融区块链应用的法律问题研究

【摘要】：区块链技术在金融领域的应用,必将引起金融领域的重大变革。区块链在金融领域的应用问题已被世界各国高度关注。其中,金融区链块应用中的法律制度构建,是应当研究的核心问题之一。积极研究并尽早建立并完善金融区块链应用相关的立法及监管,对推动区块链在金融领域的应用有着极为重要的理论意义和实践价值。本文除引言及结语部分外,主要由五个部分构成:第一部分主要讲述区块链的基本概念及其技术的来源,包括:区块链的概念、类型、运行方式及其特点;区块链的技术来源。通过对其运行方式、特点及来源简述,凸显区块链技术的先进性。第二部分主要从应用领域对区块链进行介绍,包括:区块链应用的三个类型,即以数字货币为代表的区块链1.0,以智能合约为代表的区块链2.0,以及应用于除金融领域之外的区块链3.0;简述区块链技术及其应用拓展性强的特点;我国政府及地方的态度和具体措施;英美俄欧新等五个不同地位、不同经济实力的国家和地区对于区块链的重视。第三部分主要阐述了区块链与互联网金融的关系,区块链应用的必要性、可行性及其重要性。包括:区块链与互联网金融的关系,奠定了“区块链+金融”的基调,为后文的讨论设置了前提;通过围绕比特币案例以及央行的态度,阐述了金融区块链的可行性;从信用、支付、资产管理、证券、清算结算及用户识别等六个方面详细说明区链块应用对于金融领域的重要性。第四部分主要通过比特币的案例,引伸出金融区块链应用已经或将会导致的立法、监管等法律问题等。包括:立法缺失;具体监管问题;隐私安全问题;垄断问题;“不可能三角”的应用问题;技术问题。本章末尾通过对智能合约的案例表述,对其引起的法律问题进行分析,以确定下一章的撰写基础,起到承上启下的作用。第五部分详细的提出了针对金融区块链应用所引起的法律问题的完善建议。包括:针对区块链的应用提出立法原则;对区块链、涉区块链企业及消费者方面提出了法律建议;确立监管区块链应用的立法原则;提出相关监管对策。本文的创新点包括:第一,国内在金融区块链应用领域的法律文献几乎没有,本文在选题及领域探索方面具有一定创新性;第二,本文对金融区块链应用的法律问题进行了归纳分析及总结,具有一定创新性;第三,本文对金融区块链应用立法原则、金融区块链应用立法、涉区块链金融企业的准入及权义设置、消费者权益保护、对监管的立法原则、监管主体及权义设置以及推动区块链在金融监管中应用等方面的探讨具有一定创新性。本文不足之处主要是:第一,由于笔者自身外语水平有限,外文研究资料获取能力不足;第二,金融区块链应用的相关研究多以技术方式呈现,且仍在不断更新中,由于笔者技术方面认知限制,使本文的探索在细节深度等方面还有待加强。
[Abstract]:The application of block chain technology in the field of finance will lead to great changes in the field of finance.The application of block chain in the field of finance has been highly concerned by countries all over the world.Among them, the construction of legal system in the application of chain block in financial district is one of the core problems that should be studied.It is of great theoretical significance and practical value to actively study and establish and perfect the legislation and supervision related to the application of the financial block chain to promote the application of the block chain in the field of finance.In addition to the introduction and conclusion, this paper mainly consists of five parts: the first part mainly describes the basic concepts of the block chain and its technical sources, including: the concept, type, operation mode and characteristics of the block chain, and the technical source of the block chain.The advanced nature of block chain technology is highlighted through brief description of its operation mode, characteristics and sources.The second part mainly introduces the block chain from the application field, including: the three types of block chain application,That is, block chain 1.0 represented by digital currency, block chain 2.0 represented by intelligent contract, and applied to block chain 3.0 except in the field of finance.The attitudes and concrete measures of our government and local governments, and the importance attached to the block chain by the five countries and regions with different status and different economic strength, such as Anglo-American, Russian-European and so on.The third part mainly expounds the relationship between block chain and Internet finance, the necessity, feasibility and importance of block chain application.Including: the relationship between block chain and Internet finance, set the tone of "block chain finance", set the premise for later discussion; through the case of Bitcoin and the attitude of the central bank, elaborated the feasibility of financial block chain; from the credit,Payment, asset management, securities, clearing and clearing, and user identification are six aspects that illustrate the importance of block application in the financial field.The fourth part mainly through the case of Bitcoin, the financial block-chain application has been or will lead to legal issues, such as legislation, regulation and so on.Including: lack of legislation; specific regulatory issues; privacy security issues; monopoly issues; "impossible triangle" application; technical issues.At the end of this chapter, the author analyzes the legal problems caused by the intelligent contract through the case representation, in order to determine the writing basis of the next chapter, and play the role of connecting the preceding and the following.In the fifth part, some suggestions are put forward to perfect the legal problems caused by the application of financial block chain.It includes: putting forward the legislative principle for the application of the block chain; putting forward the legal suggestion to the block chain, involving the enterprise and the consumer of the block chain; establishing the legislative principle of the application of the block chain; putting forward the relevant supervision countermeasure.The innovations of this paper include: first, there is almost no domestic legal literature in the application of financial block-chain, this paper has a certain innovation in topics and domain exploration; second,In this paper, the legal problems of the application of financial block chain are summarized and analyzed, which are innovative. Thirdly, this paper applies the principle of legislation to the application of the financial block chain, the application of the financial block chain legislation.It is innovative to discuss the access and right establishment of financial enterprises in block chain, the protection of consumers' rights and interests, the legislative principle of supervision, the subject of supervision and the establishment of right and justice, and to promote the application of block chain in financial supervision.The main shortcomings of this paper are as follows: first, due to the limited foreign language level of the author, the ability to obtain foreign language research data is insufficient; second, the related research on the application of the financial block chain is mostly presented in a technical manner, and is still in the process of updating.Due to the limitation of the author's cognition in technology, the exploration of this paper needs to be strengthened in the depth of detail and so on.
