黄河流域水资源协同治理研究

【摘要】:水资源是人类生存、社会发展的基础性自然资源和战略性经济资源。近年来,我国水污染事件频发,这样的情况下水资源的管理显得尤为重要。水资源的流域特性,决定其需要以流域为单元进行统一管理。而我国单一制的政治结构下行政区域是国家政治、经济、社会活动的基本单元,对水资源实行区域管理。在这样的政治背景下,水资源作为准公共物品存在负外部性和地方保护主义的问题,因此,应该对水资源进行流域与区域的协同治理。针对20世纪70年代开始的黄河流域断流问题国家实行的流域统一调度政策起到了明显的作用,说明流域统一管理对于解决流域问题更有效。通过完善流域管理机构的设置、配套法律制度,明确其法律地位,加强其管理职权,达到与地方政府平等的地位才能实现流域与区域的协同治理。在国家“持续推进政府职能转变”的改革进程中,政府不仅要让渡出来一定的职能范围,还要正确引导社会公众积极参与进来,从法制、行政、市场、公众等各方面实现全社会对水资源的协同治理。本文运用公共资源治理理论和近年来兴起的协同治理理论,以黄河流域水资源治理体制为对象,结合我国的社会与制度实际,探讨现行治理体制的特点、治理困境以及成因,并在此基础上提出一些改进举措。当前黄河流域水资源治理中,存在法律规范不完善,流域管理机构自身机构定位不清,条块分割矛盾明显,九龙治水乱象突出,流域管理机构缺乏有效执行权力,动员社会参与能力严重不足等问题,科层制的组织体系依靠自身很难克服这些困难。基于协同治理理论视角,论文最后指出了黄河流域水资源实现协同治理的具体路径,主要包括:改革黄河流域水资源管理体制运行机制,增强流域管理机构服务职能,通过立法加强流域管理机构职权,积极引导社会力量共同参与到黄河流域水资源治理过程之中。
[Abstract]:Water resources are the basic natural resources and strategic economic resources for human survival and social development. In recent years, water pollution incidents occur frequently in China, so the management of water resources is very important. The watershed characteristics of water resources determine the need for unified management of the basin. The administrative region is the basic unit of national politics, economy and social activities under the political structure of single system in our country, and regional management of water resources is carried out. Under such political background, there are negative externalities and local protectionism in water resources as quasi-public goods. The unified regulation policy of the Yellow River basin, which was implemented in the Yellow River basin since 1970s, has played an obvious role, which shows that the unified watershed management is more effective to solve the basin problems. By perfecting the establishment of watershed management organization, supporting legal system, clarifying its legal status, strengthening its management authority, and achieving equal status with local government, the coordinated management of watershed and region can be realized. In the course of the state's reform of "continuously promoting the transformation of government functions," the government should not only cede a certain range of functions, but also correctly guide the public to participate actively, from the legal system, the administration, and the market. The public and other aspects of the implementation of the whole society of water resources coordinated management. This paper applies the theory of public resource governance and the theory of cooperative governance that has arisen in recent years, taking the water resources management system of the Yellow River basin as the object, combining the social and institutional reality of our country, discusses the characteristics, difficulties and causes of the current governance system. And on this basis put forward some improvement measures. At present, in the management of water resources in the Yellow River basin, there are imperfect laws and regulations, unclear positioning of the watershed management agencies themselves, obvious contradictions in the division of blocks, prominent chaos in the control of water resources in Kowloon, and lack of effective executive power of the river basin management agencies. It is difficult to overcome these problems on the basis of its own organization system because of the serious insufficiency of its ability to mobilize social participation. Based on the theory of collaborative governance, the paper finally points out the specific ways to achieve coordinated management of water resources in the Yellow River basin, including: reforming the operational mechanism of the water resources management system of the Yellow River basin, and strengthening the service function of the watershed management institutions. Through legislation to strengthen the authority of river basin management institutions, actively guide social forces to participate in the Yellow River basin water resources management process.
