徐州市矿产资源生态补偿法律制度研究

【摘要】：徐州是一座典型的资源型城市,由于过去粗放式的发展理念,煤矿区生态环境问题突出。矿产资源生态补偿制度是一种新型的资源管理制度,在促进生态环境保护与资源综合利用、维护社会公平方面发挥着重要作用。实施煤矿区生态补偿制度,建立健全煤矿区生态补偿法律机制,确保生态修复高效顺利的进行,是以较低的环境代价和资源代价取得科学发展和可持续发展的有力举措,对于促进矿区生态环境保护、管理、恢复和重建都有重要的现实意义。本文以建立矿产资源型城市生态补偿法律制度为研究目标,以徐州市为研究对象,主要分为六个部分。第一部分为绪论,介绍了矿产资源生态补偿制度的研究背景,从理论和实践两个方面进行价值分析,运用科学的研究方法,提出了本文的创新点。第二部分对生态补偿和矿产资源生态补偿的概念进行了界定,提出了建立矿产资源生态补偿法律制度的经济学、生态学和法学理论基础,并介绍了实行矿产资源生态补偿制度对于我市经济、社会、环境发展的重要意义。第三部分对徐州市矿产资源开发生态补偿的制度和实践进行了分析,全面分析了徐州市生态补偿制度存在的不足之处。第四部分介绍了我国矿产资源型城市以及美国、澳大利亚等国家关于矿产资源生态补偿的实践,从中总结出在资源型城市徐州市实施矿产资源生态补偿制度的借鉴。第五部分就第三部分提出的问题,结合第四部分的启示对徐州市矿产资源生态补偿法律制度的构建提出建议。第六部分为结论。
[Abstract]:Xuzhou is a typical resource-based city, because of the extensive development concept in the past, the ecological environment problem of coal mine area is prominent. Mineral resources ecological compensation system is a new type of resource management system, which plays an important role in promoting ecological environment protection and comprehensive utilization of resources and maintaining social equity. Implementing the ecological compensation system of coal mine area, establishing and perfecting the legal mechanism of ecological compensation in coal mine area, ensuring the ecological restoration to be carried out efficiently and smoothly is a powerful measure to achieve scientific development and sustainable development at lower environmental and resource cost. It has important practical significance for promoting ecological environment protection, management, restoration and reconstruction of mining area. The purpose of this paper is to establish the legal system of ecological compensation in mineral resource-based cities, and Xuzhou City is the object of study, which is divided into six parts. The first part is the introduction, introduces the research background of mineral resources ecological compensation system, analyzes the value from two aspects of theory and practice, and puts forward the innovation of this paper by using scientific research methods. The second part defines the concepts of ecological compensation and ecological compensation of mineral resources, and puts forward the theoretical basis of economics, ecology and law to establish the legal system of ecological compensation of mineral resources. This paper also introduces the important significance of implementing the ecological compensation system of mineral resources to the economic, social and environmental development of our city. In the third part, the system and practice of ecological compensation for mineral resources exploitation in Xuzhou are analyzed, and the shortcomings of ecological compensation system in Xuzhou are analyzed. The fourth part introduces the practice of mineral resources ecological compensation in China, the United States, Australia and other countries, and summarizes the reference of implementing the mineral resources ecological compensation system in Xuzhou city. The fifth part puts forward some suggestions on the construction of the legal system of ecological compensation for mineral resources in Xuzhou, which is based on the problems raised in the third part and the enlightenment of the fourth part. The sixth part is the conclusion.
