晋江市建筑领域农民工欠薪问题的政府行为研究

【摘要】:农民工欠薪问题在很长一段时间以来一直是我国严重的社会问题,尤其突出的表现在建筑领域。2003年的“总理讨薪”事件,掀开了全国各地整治和清欠农民工工资行动的大幕,此后的几年,各地关于清欠成果的报道常见诸于媒体,欠薪问题一度得到有效遏制。然而,随着我国城市化进程的不断加快,建筑领域农民工欠薪问题仍然发生着并在每年的年终岁末持续如火如荼上演各种讨薪事件,继续冲击着当前劳动关系的和谐及社会的安定稳定。本文试图通过以晋江市建筑领域农民工欠薪问题为研究对象,着重从政府行为进行深入分析,阐明建筑领域农民工欠薪现状,点出问题的根源,以及在治理这一问题上的法律难题、行业背景、路径依赖和现实困境,尤其是联系晋江的实际,从具体政府行为的优化角度去探寻更适宜、更有效的政府治理对策。建筑领域欠薪是个老话题,也是热点问题,仅国内学术界对此问题的研究就已较为深入,在此基础上,本文尝试以政府行为作为研究的内容和视角,界定农民工欠薪和政府行为的概念,以政府治理、新公共服务作为理论支撑,引入政府参与解决建筑领域欠薪的必要性和可行性,结合晋江市治理的现状深入分析和实证研究,通过相关利益主体和政府部门的心理博弈分析,发现当前做法存在的缺陷和影响因素,借鉴国内其他城市的有效经验,尝试提出针对晋江市实际行之有效的优化建议,期望随着政府治理的完善和其他方面的共同努力,建筑领域欠薪这一顽疾能够得到有效的遏止。
[Abstract]:The problem of migrant workers' unpaid wages has been a serious social problem in China for a long time, especially in the field of construction. The 2003 incident of "asking for wages by the Prime Minister" has opened a big curtain for the rectification and action to clear up the wages of migrant workers throughout the country.In the years that followed, local reports of outstanding results were frequently reported in the media, and the issue of unpaid wages was effectively curbed.However, with the rapid development of urbanization in China, the problem of migrant workers' unpaid wages in the construction field still occurs and continues to play out in full swing at the end of each year's end of the year.Continue to impact on the current harmonious labor relations and social stability and stability.This paper attempts to take the problem of migrant workers in the construction field of Jinjiang as the research object, focusing on the in-depth analysis of the government behavior, to clarify the current situation of migrant workers in the construction field, and to point out the root of the problem.And the legal problems, industry background, path dependence and practical difficulties in governance, especially in connection with the reality of Jinjiang, from the point of view of the optimization of specific government behavior to explore more appropriate, more effective government governance countermeasures.Unpaid wages in the field of construction is an old topic, but also a hot issue, only the domestic academic research on this issue has been more in-depth, on the basis of this, this paper tries to take government behavior as the research content and perspective.Defining the concepts of migrant workers' unpaid wages and government behavior, taking government governance and new public services as theoretical support, introducing the necessity and feasibility of government participation in solving the problem of unpaid wages in the construction field, and combining the current situation of governance in Jinjiang City with an in-depth analysis and empirical research.Through the psychological game analysis of relevant stakeholders and government departments, this paper finds out the defects and influencing factors existing in the current practice, draws lessons from the effective experience of other cities in China, and tries to put forward some practical and effective optimization suggestions for Jinjiang City.It is hoped that with the improvement of government governance and the joint efforts of other parties, the persistent problem of unpaid wages in the construction field will be effectively curbed.
