建设工程合同信用对合同管理绩效的影响研究

【摘要】:现代建设工程项目是一项复杂的系统工程。在建设工程项目实施过程中,众多项目参与方之间,存在不同的合同关系。合同管理从建设工程的策划、施工到竣工等各个阶段都不可缺少且任务各不相同,因此,合同确定了工程的成本、工期、质量等总体目标,规定和明确了当事各方的权利和义务。而在实际的工程管理过程当中,合同违约、违法现象频繁出现,导致合同信用的缺失,使项目参与主体间信任受损,进而可能造成工程质量不达标、资金和资源浪费等问题。本文基于国内外对合同管理主体和任务的研究基础,首先,结合信用和绩效的相关理论方法,对建设工程合同信用和合同管理绩效的内涵进行了系统性分析与界定;其次,运用系统论方法对合同全寿命周期的主要任务、目标和特点进行了分析和归纳总结,从合同策划、合同签订、合同履行与合同终止四个阶段全面和系统的分析了影响合同信用和合同管理绩效的变量和指标,初步建立了二者的指标体系;再次,通过问卷调研和相关统计分析工具对初选指标体系进行筛选,进而得到影响变量的关键指标,并结合合同信用对合同管理绩效的影响关系分析,从而构建了变量之间的指标体系和假设模型;最后基于结构方程模型理论对假设模型进行拟合和修正,得到较为优化和准确的模型。通过对模型的分析研究,可以在一定程度上得到建设工程项目中合同信用与合同管理绩效的影响关系和存在的影响因子,最终使工程参与方之间实现更有益的合作和共赢关系,对项目参与方提高自身合同管理的信用水平和管理绩效水平,具有一定的理论意义和参考价值。
[Abstract]:Modern construction project is a complex system engineering. In the process of construction project implementation, there are different contractual relationships among many project participants. The contract management is indispensable from the planning of the construction project to the completion of the project, and the tasks are different. Therefore, the contract determines the overall objectives of the project, such as cost, time limit, quality, etc. The rights and obligations of the parties are defined and clarified. In the actual project management process, the contract breach of contract, illegal phenomenon frequently appears, resulting in the lack of contract credit, the project participants trust damage, which may lead to the project quality standards, capital and resource waste and other problems. Based on the domestic and foreign research on the subject and task of contract management, firstly, combining the related theories and methods of credit and performance, this paper systematically analyzes and defines the connotation of contract credit and contract management performance of construction project; secondly, This paper analyzes and summarizes the main tasks, objectives and characteristics of the whole life cycle of the contract by using the method of system theory, from the aspects of contract planning, contract signing, The four stages of contract performance and contract termination are comprehensively and systematically analyzed the variables and indicators that affect contract credit and contract management performance. Through the questionnaire survey and related statistical analysis tools to select the primary index system, and then get the key indicators of the impact variables, and combined with the contract credit impact on contract management performance analysis. Then the index system and the hypothesis model between variables are constructed, and the optimal and accurate model is obtained by fitting and modifying the hypothesis model based on the structural equation model theory. Through the analysis and study of the model, the relationship between contract credit and contract management performance and the existing influence factors can be obtained to a certain extent, and finally the beneficial cooperation and win-win relationship between the project participants can be realized. It has certain theoretical significance and reference value for the project participants to improve their own contract management credit level and management performance level.
