大型建设项目EPC合同争端预警管理体系研究

【摘要】:EPC总承包在所有的总承包模式中最具代表性,并且是使用最频繁的总承包合同之一,尤其是在国际工程承包中运用最为普遍。自2003年原建设部30号文件颁发之后,EPC总承包越来越受到国内发包方的采用。EPC总承包是指工程总承包企业按照合同约定,承担工程项目的设计、采购、施工、试运行服务等工作,并对承包工程的质量、安全、工期、造价全面负责。但在实际运用当中,管理者要处理很多潜在的问题,其中EPC合同争端问题尤为突出。首先,对EPC合同的特点及分类、引发争端原因、争端的特点及分类、EPC合同基本信息分析和争端预警现状进行分析,分析结果体现出EPC合同易于产生争端。其次,研究了EPC合同解决争端成本的构成和产生争端的后果,表明EPC合同一旦产生争端,将会给合同双方带来严重的后果并且代价极其严重。再次,为了预防、警告和跟踪争端,根据争端产生某些征兆性比较强的信息、产生争端的原因和EPC合同自身特点,综合运用推理理论、粗糙集理论、熵权法和欧氏距离检索法构建定性与定量相集成的案例推理与规则推理相融合(CCBR+RBR)模型来预防和警告有可能发生的争端并进行实时跟踪。进而,在CBR+RBR模型基础上,增加枚举法对EPC合同可能产生争端的关键因素进行分析,通过实时控制关键因素对EPC合同进行争端预警。最后,通过案例分析来验证模型对EPC合同争端预警的实现。基于上述方法,组建了由业主、总承包和DAB争端裁决委员会三方联合构成的争端预警小组并且设计了矩阵式人员职责划分。该小组具有“三方联动”的作用,可以达到“3+14”的管理效果。
[Abstract]:EPC general contracting is the most representative of all general contracting modes, and it is one of the most frequently used general contracting contracts, especially in international engineering contracting. Since the issuance of the document No. 30 of the former Ministry of Construction in 2003, the EPC general contract has been adopted by the domestic contracting parties more and more. EPC general contracting means that the general contracting enterprises undertake the design, procurement, construction, trial operation and other services of the project in accordance with the contract. And the quality of the contract project, safety, duration, cost of the overall responsibility. But in practice, managers have to deal with many potential problems, especially EPC contract disputes. Firstly, the characteristics and classification of EPC contracts, the causes of disputes, the characteristics and classification of disputes, the basic information analysis of EPC contracts and the current situation of dispute warning are analyzed. The results show that EPC contracts are prone to disputes. Secondly, the paper studies the composition of the dispute settlement cost and the result of the dispute in the EPC contract. It shows that once the dispute arises in the EPC contract, it will bring serious consequences to both parties and the cost will be extremely serious. Thirdly, in order to prevent, warn and follow up disputes, according to the information of some symptoms, the causes of disputes and the characteristics of EPC contracts, the reasoning theory and rough set theory are used synthetically. Entropy weight method and Euclidean distance Retrieval (Euclidean distance Retrieval) method are used to construct a (CCBR RBR) model which integrates qualitative and quantitative case-based reasoning and rule-based reasoning to prevent and warn possible disputes and to track them in real time. Furthermore, on the basis of CBR RBR model, adding enumeration method is used to analyze the key factors that may lead to disputes in EPC contracts, and to forewarn the disputes of EPC contracts by controlling key factors in real time. Finally, the paper verifies the realization of EPC contract dispute early warning by case analysis. Based on the above method, a dispute early warning group composed of owner, general contract and DAB dispute adjudication committee is set up and a matrix division of personnel duties is designed. The group has the function of "tripartite linkage" and can achieve the management effect of "3-14".
