网络侵犯著作权行为的立法思考

【摘要】：互联网的兴起,在给我们带来巨大的便利的同时,也产生了很多以前未曾出现、现行法律亦难以解决的侵权问题,而网络侵权行为中最为普遍、影响最大的,是网络侵犯著作权行为。对网络侵犯著作权的概念界定、分类、惩罚措施以及如何防范一直是近年来的国际和国内的法律课题上的热点。随着我国法治的不断完善,不少学者、专家都正在对网络侵犯著作权行为的立法做出一些有益的探索和思考。但网络的发展日新月异,所产生的问题层出不穷,难免有思虑不周全之处。本文第一部分就选题背景和研究综述做了基本介绍。网络侵犯著作权作为近年来新兴的法律课题,大量学者做了有意义的研究工作。但国内相关立法与发达国家相比,有先天和后天的不足。一些影响重大的个案也众说纷纭,国内还没有权威性的专著和专门法律对网络侵犯著作权行为做出规定,这也是本文选题的重要原因之一。本部分还就研究内容和研究方法作了说明。第二部分主要介绍了网络侵犯著作权行为的时代背景、概念和特征、分类以及表现形式。明晰了网络侵犯著作权的含义,才能够有针对性、准确的进行立法规范。第三部分简要介绍了国际上对网络侵犯著作权行为的相关立法。如《TRIPs协议》及因特网条约、美国、欧盟、澳大利亚等发达国家的有关规定,并对这些规定进行了评价与分析。第四部分介绍了两个网络侵犯著作权方面国际上的经典案例。发达国家较中国更早发展互联网,也相应的更早出现了网络侵犯著作权的问题。国外的相关判例对中国如何进行立法有非常重要的借鉴意义。第五部分从行政、刑事、民事和技术措施方面概述了我国对网络侵犯著作权的立法现状。第六部分就我国网络环境下的著作权保护提出了意见与建议。
[Abstract]:The rise of the Internet has brought us great convenience, but also produced a lot of previously never appeared, the current law is also difficult to solve the problem of infringement, and network infringement is the most common, the greatest impact. The concept of network infringement of copyright is defined and classified. Punishment measures and how to prevent has been a hot spot in the international and domestic legal issues in recent years. With the continuous improvement of the rule of law in China, many scholars. Experts are making some useful explorations and reflections on the legislation of network infringement of copyright. However, with the rapid development of the network, the resulting problems emerge one after another. The first part of this paper makes a basic introduction to the background of the topic and the summary of the research. Network infringement of copyright as a new legal topic in recent years. A large number of scholars have done meaningful research work. However, compared with the developed countries, the relevant domestic legislation has congenital and acquired deficiencies. There are no authoritative monographs and special laws for copyright infringement in China, which is one of the important reasons for this thesis. This part also explains the research contents and methods. The second part mainly introduces the era background, concept and characteristics, classification and manifestation of the copyright infringement on the network. Only by clarifying the meaning of the network infringement of copyright, can it be targeted. To regulate legislation accurately. The third part briefly introduces the relevant legislation of international copyright infringement, such as "TRIPs Protocol" and Internet treaties, the United States, the European Union, Australia and other developed countries. These regulations are evaluated and analyzed. Part 4th introduces two international classic cases of copyright infringement. Developed countries developed the Internet earlier than China. Accordingly, the problem of network infringement of copyright appeared earlier. The relevant cases abroad have a very important reference significance for how to legislate in China. In the 5th part, the author summarizes the current situation of China's legislation on network infringement of copyright from the aspects of administrative, criminal, civil and technical measures. Part 6th puts forward some suggestions on copyright protection in China's network environment.
