【摘要】:在我国网络游戏著作权侵权案件的判定中,由于案件的复杂多变,认定网络游戏的作品属性是一个难题。而当网络游戏的构成要素被抄袭或遭遇其他著作权侵权问题时,如何对这些要素进行作品属性认定,在现实中需要亟待解决。本文通过对网络游戏进行分类,从网络游戏的设计和开发的角度将不同类型的网络游戏进行构成要素的抽象性分析,然后对这些要素进行归纳和总结,总结出网络游戏可能具备的一般性要素,继而对这些一般性要素属于思想还是表达进行理论研究,总结出属于表达的要素,对这些表达要素的独创性判定进行阐述。论文共分为五个部分:首先介绍了司法实践中比较具有代表性的两则案例;第二部分对网络游戏著作权的侵权现状和侵权类型进行总结,由此引出针对网络游戏著作权侵权的理论分歧;第三部分是论文的主体部分,在对网络游戏的分类进行分析后,对不同分类的要素进行探究和抽象化,总结出网络游戏的一般性要素,然后将这些要素与著作权法的基本理论结合,将属于表达的要素总结后,进行独创性标准的研究,在对该部分总结后,利用得出的理论对评析案例;第四部分是通过对网络游戏的作品属性分析后,提出网络游戏著作权立法建议以及如何保护;最后一部分对全文进行了总结。对于网络游戏的作品属性,总结如下:在遇到涉及整体侵犯网络游戏著作权的情况下,网络游戏可以作为一个整体被给予著作权法的保护,而在涉及到网络游戏的要素侵权时,这些要素也可以作为著作权法意义上的作品,给予单独的保护。因此建议将网络游戏纳入著作权法的作品范围之中。
[Abstract]:In the judgment of copyright infringement cases of online games in our country, because of the complexity of the cases, it is a difficult problem to determine the property of the works of online games. However, when the composing elements of online games are copied or other copyright infringement problems are encountered, how to identify the properties of these elements needs to be solved urgently in reality. By classifying the online games, this paper analyzes the abstractness of the components of different types of online games from the point of view of the design and development of the online games, and then sums up and summarizes these elements. This paper summarizes the possible general elements of online games, and then makes a theoretical study of whether these general elements belong to thought or expression, sums up the elements that belong to expression, and expounds the originality of these elements of expression. The thesis is divided into five parts: firstly, it introduces two typical cases in judicial practice; the second part summarizes the status quo and types of infringement of online game copyright. The third part is the main part of the paper. After analyzing the classification of online games, it explores and abstracts the elements of different categories. This paper summarizes the general elements of online games, and then combines these elements with the basic theory of copyright law, sums up the elements that belong to the expression, and studies the originality of the standards. The fourth part is through the analysis of the properties of the works of online games, put forward the legislative recommendations and how to protect the copyright of online games; the last part of the full text is summarized. The characteristics of online games are summarized as follows: when it comes to the whole infringement of the copyright of online games, the online games can be protected by copyright law as a whole, and when the elements of online games are infringed, These elements may also be protected separately as works in the sense of copyright law. Therefore, it is suggested to bring online games into the scope of copyright law.
