上海书业公会版权维护研究（1905-1937）

【摘要】：上海书业公会是上海地区书业自筹自建,以维护同业公益,矫正行业弊病为活动宗旨的同业公会组织。该组织于1905年至1958年间延续活动,在书业界有广泛影响,但是学界并未给予相应的重视。笔者仅选取1905年至1937年一段,就组织的版权维护活动为中心进行考察,旨在窥探民间同业公会组织于维护版权方面的运作状况,探讨其成败得失。本文正文共五部分：第一部分,主要介绍上海书业公会兴起的社会背景及组织沿革。出版业的近代化及民营出版业的崛起,使近代书业同业公会组织的产生成为时代需要,而近代版权意识的萌生,则促使书业界的领军——上海书业公会在其存在期间,一直将维护版权作为组织的主要活动内容之一。第二部分,介绍上海书业公会主要的版权维护活动。为维护版权,上海书业公会制度建设与组织建设并重,积极协调同业版权纠纷,协助同业查究伪版,对政府版权立法、地方著作权事务以及涉外版权活动,都积极参与,充分发挥其主动性。第三部分,就上海书业公会为维护版权与同业及政府间的交涉作分析。作为业界领袖,上海书业公会积极沟通、联合同业,共同致力于维护版权；作为中间组织,上海书业公会积极活动于政府与书业界之间,为同业利益积极奔走,争取出版权益。第四部分,就查究伪版委员会及驻平办事处为个案,窥探组织在维护版权方面的活动开展及经费收支情况,评析其活动效果。第五部分,就上海书业公会的版权维护活动做简要评析。作为同业间、同业与政府间沟通的平台,上海书业公会致力于版权维护的努力,顺应了时代的需求,也维护了同业的利益。该组织在维护版权活动中所体现的尴尬,也启示当下的版权维护需要行业组织积极性法的更大发挥,同时,政府对维护版权也当担负起应有的责任。
[Abstract]:Shanghai Book Guild is a self-organized trade association in Shanghai, which aims at maintaining the commonweal and correcting the maladies of the industry. The organization continued its activities from 1905 to 1958 and had extensive influence in the book industry, but the academic circles did not pay attention to it. The author chooses only one section from 1905 to 1937 to investigate the copyright maintenance activities of the organization. The purpose of this study is to probe into the operation of the folk trade association in the protection of copyright and to discuss its success or failure. There are five parts in the text: The first part mainly introduces the social background and organizational evolution of Shanghai Book Industry Association. With the modernization of the publishing industry and the rise of the private publishing industry, the emergence of the modern book trade association has become the need of the times, and the emergence of the modern copyright consciousness has prompted the book industry leader, the Shanghai Book Industry Guild, during its existence. Copyright protection has always been one of the main activities of the organization. The second part introduces the main copyright protection activities of Shanghai Book Industry Association. In order to protect copyright, the Shanghai Book Industry Association pays equal attention to the construction of the system and the organization, actively coordinates the copyright disputes in the same trade, assists the industry in the investigation of fake editions, and actively participates in government copyright legislation, local copyright matters and foreign copyright activities. Give full play to its initiative. In the third part, the author analyzes the negotiations between Shanghai Book Industry Association and its counterparts and governments for copyright protection. As an industry leader, the Shanghai Book Industry Association actively communicates, associates with the same industry and works together to protect copyright; as an intermediate organization, the Shanghai Book Industry Association actively acts between the government and the book industry, actively works for the interests of the industry and strives for publishing rights. In the fourth part, the investigation of the fake edition committee and the office in Pingping as a case, to explore the activities of the organization in the copyright protection activities and the income and expenditure situation, and evaluate the effectiveness of its activities. The fifth part makes a brief comment on the copyright protection activities of Shanghai Book Industry Association. As a platform for communication between the industry and the government, the Shanghai Book Industry Association devotes itself to the protection of copyright, conforms to the needs of the times and protects the interests of the same industry. The embarrassment of the organization in the copyright protection activities also reveals that the current copyright protection needs to be brought into greater play by the positive laws of trade organizations. At the same time, the government should shoulder its due responsibility for the protection of copyright.
