版式设计的著作权法保护:排版劳动与审美表达——兼评吉林美术出版社诉海南出版社再审案

【摘要】:我国版式设计专有权的权利对象和边界不清,其根源是错误地以为版式设计专有权的对象是"版式设计"。版式设计受著作权法保护,正当基础不外乎排版劳动与审美表达。一方面,按照既定的版式设计逐页手工拣字、对齐,或者用电脑编辑作品,需要付出实质性劳动,这适合采用邻接权保护。据此,只有以原样复制此种版式设计出版同样内容的图书期刊才构成侵权。另一方面,以字符作为绘画创作元素,变形配色并结合图案、留白,由此形成的用于宣传的图文版式设计属于"作品",其审美表达如果具有独创性,则应作为美术作品享有著作权。在这两种法理基础之外,再以鼓励创新为由对"版式设计模板"类推适用版式设计专有权保护,不但不能鼓励版式设计模板直接开发者投入创新,反而容易导致法律适用混乱。
[Abstract]:The right object and boundary of typography exclusive right in our country are unclear, the root of which is that the object of typography exclusive right is "layout design". Typography is protected by copyright law and is based on typesetting labor and aesthetic expression. On the one hand, according to the established layout design, manually pick words page by page, align, or edit works with computer, need to pay substantive labor, which is suitable for the protection of neighboring rights. Therefore, only the original reproduction of this layout design to publish the same content of books and periodicals constitutes an infringement. On the other hand, taking characters as the elements of painting creation, changing and matching colors and combining patterns, leaving space, the resulting graphic and text layout design for propaganda belongs to "works", if its aesthetic expression is original, It should enjoy copyright as a work of art. In addition to these two kinds of legal theories, the exclusive right to apply layout design to "layout design template" by analogy is protected by encouraging innovation, which not only can not encourage the developers to invest in innovation directly, but also lead to confusion in the application of law.
