法治精神与廉政文化建设关系研究

【摘要】：一直以来,人类与腐败进行着不断的斗争,加强对权力的监督和制约,构建和完善相应的廉政文化是全人类共同的不懈追求。党的十八大以来,党中央高度重视、全面推进党风建设,廉政文化建设现今已成为一个热门话题,廉政文化建设的形式也呈现多样化趋势。在这个过程中,与法治精神的结合是推进廉政文化建设进一步发展的必然要求。实践证明,没有法治精神相关理念的支撑,廉政文化建设只是空中楼阁。目前,我国的廉政文化建设仍主要依靠道德建设,一方面缺少制度的硬性规定,另一方面廉政建设主体缺乏法治意识。厘清法治精神与廉政文化建设的内在关系,把法治精神作为构建廉政文化的重要内容,对我国廉洁政府的建设,依法治国方略的贯彻,必将起到有力的推动作用。因此,研究我国法治精神与廉政文化建设的现状以及国外相关的成功经验,探索正确处理法治精神与廉政文化建设的关系,对于推进我国廉政文化建设以及建设廉洁政府具有积极意义。本文除引言和结语外,分为四大部分：第一部分从法治精神和廉政文化建设的理论入手,阐述了各相关概念的内涵,论述了法治精神的基本理念与廉政文化建设要求的一致性,说明廉政文化建设离不开法治精神的支撑。第二部分分析了我国廉政文化建设中存在的问题,并分析了相关问题产生的原因。第三部分通过考查分析境外处理法治精神与廉政文化建设关系的成功范例,借鉴其相关经验。第四部分在借鉴境外经验的基础上结合我国具体实际,就我国正确处理廉政文化与法治精神关系提出了具体三点建议：完善廉政立法加快廉政文化建设、健全廉政机构保障廉政文化建设、加强廉政监督促进廉政文化建设。
[Abstract]:Human beings have been constantly fighting against corruption. It is the common and unremitting pursuit of all mankind to strengthen the supervision and restriction of power and to construct and perfect the corresponding culture of clean government. Since the 18 Congress of the CPC. The CPC Central Committee attaches great importance to promoting the construction of the Party style in an all-round way, and the construction of a clean government culture has become a hot topic, and the forms of the construction of a clean government culture are also showing a diversified trend. The combination with the spirit of the rule of law is an inevitable requirement for the further development of the cultural construction of a clean government. Practice has proved that without the support of the related concepts of the spirit of the rule of law, the construction of a clean government culture is just a castle in the air. The construction of clean government culture in our country still mainly relies on moral construction. On the one hand, it lacks the rigid regulation of the system, on the other hand, the subject of clean government construction lacks the consciousness of rule of law. Taking the spirit of rule of law as an important part of the construction of clean and honest government and the implementation of the strategy of governing the country according to law will certainly play a powerful role in promoting it. This paper studies the present situation of the spirit of ruling by law and the construction of clean government culture in China and the successful experience of foreign countries, and explores the relationship between the spirit of rule of law and the construction of clean government culture. In addition to the introduction and conclusion, this paper is divided into four parts: the first part starts with the spirit of rule of law and the theory of clean government construction. This paper expounds the connotation of various related concepts and discusses the consistency between the basic concept of the spirit of rule of law and the requirements of building a clean government culture. It shows that the construction of clean government culture can not be separated from the support of the spirit of the rule of law. The second part analyzes the problems existing in the construction of clean government culture in China. The third part analyzes the successful examples of the relationship between the spirit of rule of law and the construction of clean government culture. Learn from its relevant experience. 4th part of the foreign experience on the basis of the combination of China's specific reality. This paper puts forward three specific suggestions on how to correctly deal with the relationship between the culture of clean government and the spirit of rule by law: perfecting the legislation of clean administration and speeding up the construction of culture of clean government, and perfecting the organization of clean administration to guarantee the construction of. Strengthening the supervision of a clean government and promoting the building of a clean government culture.
