自媒体时代网络反腐公众参与的监管机制研究

【摘要】：飞速发展的网络信息时代给人们的生活带来巨大的影响,自媒体的产生可以说是网络传播技术的一个新起点。自媒体是一种更自主、更大众甚至更个人的传播者,通过使用现代的电子高科技技术,向一些有相似背景或者没有相似背景的单个人以及群体,传递不规范性和规范性信息内容的新媒体的总称。而网络自媒体更主要以论坛、博客、微博、微信等形式,给人们的生活带来了方方面面的巨大影响。然而新时期网络反腐作为反腐的一种新形式,在反腐的领域中以其特有的运行模式展现出了旺盛的生命力,并切成为了一把不可忽视的反腐尖刀。网络反腐通过对腐败现象起到强力的威慑作用,使广大群众的权利意识和政治参与的积极性萌发,完善了制度反腐,促进了政府作为,同时它又是一把“双刃剑”,它本身也有一定的缺陷,会产生伤及无辜他人、侵犯他人人隐私、污染网络环境、扰乱社会生活等后果。通过对自媒体时代网络反腐公众参与监管机制整个核心概念的分解解读,有利于准确把握文章的主旨,对公众参与反腐的监管机制进行研究;对自媒体时代网络反腐公众参与的监管机制研究的现状、产生的问题及原因进行研究,现状包括立法规定与实行状况,立法规定主要指在宪法,行政法规,以及刑法、刑诉法、民法相关规定下,政府监管机制如何运行,而实行状况则指公安机关监管、纪检监察机关监管、检察机关的监管;问题则包括法律法规缺失、监管机制不够完善、监管主体不明,监管责任不清、监管范围有限、监管手段不力、对实名举报人保障不力、对违法参与者追究不利;而原因则包括:参与主体素质参差不齐、政府反腐敷衍塞则致使公民参与反腐言行出格;对自媒体时代网络反腐公众参与的监管机制的完善,包括:完善法律法规;完善监管机制,具体又包括:全面推行公务员财产申报与公示制度、相关部门加强技术创新手段,加大对网络内容的技术监管、推行实名制注册、建立信息共享机制、建立网络监督投诉平台;明确监管主体,分清监管责任;扩大监管范围;加强监管力度;加大对实名举报人的保障力度;严厉制裁违法犯罪行为。
