反腐视角下境外追逃法律问题研究

【摘要】：贪官外逃成为我国反腐败工作顺利进行的一大障碍,如何将外逃官员成功缉拿归案,接受我国法律的制裁成为目前学者研究的一大热题。我国近年来在境外追逃的过程中虽然取得了相当大的进展,但从目前我国境外追逃的情况来看,形势仍不容乐观。本文共分为四个部分:第一部分是境外追逃概述。指出境外追逃的基本概念、特点以及我国反腐败境外追逃的历史沿革、现状。我国境外追逃取得了一定的成绩,但与潜逃在外的官员相比,追回的人员只是冰山一角。因此我国不断加大追逃力度,加强反腐败国际合作,提高我国在国际反腐中的地位。党的十八届四中全会强调要加大追逃追赃、引渡遣返的力度。第二部分提出了境外追逃的对象。境外追逃的对象包括人与物,将外逃官员追捕回国接受我国法律制裁是我国境外追逃的最终目的。贪官携款潜逃给我国带来经济、政治、社会等方面的危害,为追逃工作顺利进行,应明确外逃人员所具有的特点。明确外逃人员特点及其去向,有利于我国境外追逃工作的顺利开展。追回转移到国外的腐败资产有助于瓦解外逃官员在国外的经济基础,使境外追逃工作顺利进行。第三部分主要介绍的是境外追逃的方式及其存在的问题。引渡无疑是追回外逃贪官的最主要的途径,但因引渡的原则以及从我国引渡条约签订的数量和质量来看,我国境外追逃运用引渡方式存在一定的困境,本文针对引渡中所存在的问题提出解决思路。积极运用引渡的替代措施,发挥其在境外追逃工作中的作用,对外逃官员采取多管齐下的追逃策略。第四部分主要阐释的是完善境外追逃的法律建议。目前我国《引渡法》的规定存在着与《联合国反腐败公约》不一致的地方。对《引渡法》的进一步修改,使其进一步与《联合国反腐败公约》相接轨。劝返在追逃中发挥了极大的作用,其本身也具有程序性弱化的特点,但我国法律对于劝返并没有明确的规定。司法机关应尽快出台关于劝返的法律规定和司法解释,为司法机关和政府机关在境外追逃中运用劝返方式时有明确的法律依据。通过制定合理的资产分享制度促进境外追逃的顺利进行。
[Abstract]:Corrupt officials flight has become a major obstacle to the smooth progress of anti-corruption work in China. How to successfully arrest and bring flight officials to justice and accept legal sanctions has become a hot topic for scholars at present. Although China has made great progress in the process of pursuing and fleeing abroad in recent years, the situation is still not optimistic. This paper is divided into four parts: the first part is an overview of overseas pursuit. This paper points out the basic concept and characteristics of overseas pursuit and the historical evolution and present situation of our country's anti-corruption pursuit abroad. Some achievements have been made in pursuing and escaping abroad, but the recovered personnel are only the tip of the iceberg compared with the absconded officials. Therefore, our country continuously strengthens the strength of pursuing and escaping, strengthens the international cooperation against corruption, enhances our country's position in the international anti-corruption. The fourth Plenary session of the 18th CPC Central Committee stressed the need to step up the pursuit of stolen goods, extradition and repatriation. The second part puts forward the object of overseas pursuit. The object of overseas pursuit includes people and objects. It is the ultimate purpose of our country to pursue and return the fleeing officials to accept the legal sanction of our country. The corrupt officials absconded with funds brought to our country economic, political, social and other harm, in order to pursue and escape smoothly, we should make clear the characteristics of flight personnel. To clarify the characteristics and destination of the fleeing personnel is beneficial to the smooth development of the overseas pursuit. Recovering the corrupt assets transferred to foreign countries helps to disintegrate the economic base of flight officials abroad and make the pursuit of overseas escape proceed smoothly. The third part mainly introduces the way of overseas pursuit and its existing problems. Extradition is undoubtedly the most important way to recover the corrupt officials who fled abroad. However, because of the principle of extradition and the quantity and quality of extradition treaties signed by our country, there are certain difficulties in the way of extradition in pursuit of flight abroad. This paper puts forward solutions to the problems existing in extradition. We should make full use of the alternative measures of extradition, give play to its role in the work of pursuing and escaping abroad, and adopt a multi-pronged strategy of pursuing and escaping the officials of flight. The fourth part mainly explains the legal advice of perfecting the pursuit of foreign countries. At present, the provisions of extradition Law are inconsistent with the UN Convention against Corruption. The extradition Law is further amended to bring it into line with the UN Convention against Corruption. Exhortation plays a great role in the pursuit of escape, and it also has the characteristic of procedural weakening. However, there is no clear stipulation on persuasion in Chinese law. The judicial organ should issue the legal regulation and the judicial explanation about the exhortation as soon as possible, so as to have the clear legal basis for the judicial organ and the government organ to use the exhortation method in the overseas pursue and escape. Through the establishment of a reasonable asset-sharing system to promote the smooth pursuit of overseas escape.
