容错机制构建的制度困境与破解之策

【摘要】：正近年来,各地纷纷开展了容错机制方面的探索,出台了与容错纠错密切相关的法律文件,为党政干部容错免责机制的构建提供了基本模式,有助于正确理解容错机制的目的与内容,合理厘清容错机制的边界。但鉴于该制度构建处于初期的事实,其依然面临着法治第一性、制度合理性等诸多方面的问题。因此,从全面从严治党的宗旨出发,建立健全全国统一的容错机制实属必要。
[Abstract]:In recent years, the exploration of fault-tolerant mechanism has been carried out all over the world, and the legal documents closely related to fault-tolerant and error-correcting have been issued, which provide a basic model for the construction of fault-tolerant exemption mechanism for party and government cadres. It is helpful to understand the purpose and content of fault-tolerant mechanism and to clarify the boundary of fault-tolerant mechanism. However, in view of the fact that the system is in its infancy, it still faces many problems, such as the primacy of the rule of law and the rationality of the system. Therefore, it is necessary to establish and perfect the fault-tolerant mechanism of the whole country from the aim of managing the Party strictly.
