【摘要】：司法鉴定人制度是司法鉴定制度的核心,然而我国鉴定人制度存在着诸多不完善的地方,妨碍了司法鉴定作用的发挥。对于我国司法鉴定人制度何去何从,理论界和和司法界各抒已见,争论不休。在介绍司法鉴定人制度基本理论的基础上,着重阐述了我国司法鉴定人制度存在的缺陷及成因,深入剖析和梳理了两大法系司法鉴定人制度的现状和发展趋势,提出完善我国司法鉴定人制度的设想。全文共分为四部分。第一部分,司法鉴定人制度概论。介绍司法鉴定人概念、特征、易混淆的几个概念,以及司法鉴定人制度概念、司法鉴定人制度与司法鉴定的关系。第二部分,我国司法鉴定人制度存在的缺陷及原因。在说明我国鉴定人制度立法现状基础上,指出我国鉴定人制度中存在的问题和产生的原因。第三部分,两大法系司法鉴定人制度的考证。主要从英美法系专家证人和大陆法系司法鉴定人的地位、资格、选任、权利、义务、法律责任以及制度评析六个方面进行探讨和阐述,指出各自的利弊和发展趋势,以期对我国司法鉴定人制度的改革和完善起到学习和借鉴的作用。第四部分,我国司法鉴定人制度的改革和完善。宏观上指出应当加强司法鉴定人制度的理论研究和我国司法鉴定人制度模式以鉴定人为主,专家辅助人为补充的司法鉴定人制度;微观上提出如何从我国司法鉴人的资格、选任、法律责任、鉴定人协会、专家辅助人等具体制度进行完善。
[Abstract]:The judicial appraisal system is the core of the judicial appraisal system . However , there are many imperfect places in the system of judicial appraisal , which hinders the exertion of judicial appraisal . On the basis of introducing the basic theory of the judicial appraisal system , the defects and causes of the judicial appraisal system in our country are introduced , and the present situation and the developing trend of the judicial appraisal system of the two systems are analyzed and analyzed , and the idea of perfecting the system of judicial authentication is put forward . The full text is divided into four parts . The first part is an overview of the system of judicial appraisal . It introduces several concepts , such as the concept , characteristics and easy confusion of judicial appraisal , and the relationship between the concept of judicial appraisal , the system of judicial appraisal and judicial appraisal . The second part , on the basis of the present situation of our country ' s appraisal system legislation , points out the problems and causes in our country ' s appraisal system . The third part , the two major legal system ' s appraisal of the human system , mainly from the Anglo - American law system expert witness and the civil law system judicial appraisal person status , qualification , election , rights , obligation , legal responsibility and system assessment six aspects to discuss and elaborate , point out the respective advantages and disadvantages and the developing trend , with a view to the reform and perfection of the judicial appraisal system of our country to play the role of learning and reference . The fourth part , the reform and improvement of the judicial appraisal system in our country . On the macro level , it is pointed out that the theoretical research of the judicial appraisal system should be strengthened and the system mode of the judicial authentication in China should be strengthened .
