【摘要】： 文化与犯罪存在千丝万缕的联系。文化分为主流文化和亚文化,而亚文化尤其是犯罪亚文化对青少年的犯罪行为产生了很大的影响。近年来,虽然理论界和实务界高度重视青少年犯罪问题,但从笔者掌握的数据来看,我国青少年犯罪人数仍呈现出逐年上升的趋势。一般来说,青少年犯罪和其他犯罪现象一样,是自然原因、社会原因、个体原因和文化原因综合作用的结果。但犯罪亚文化是青少年犯罪的诱因之一,对引发青少年犯罪所起的作用不可小觑。本文围绕犯罪亚文化与青少年犯罪这个命题,分为四个部分进行论述。第一章运用所掌握的数据分析我国青少年犯罪的总体情况以及基本特点。目前,我国青少年犯罪呈现两个基本态势:第一,犯罪青少年在犯罪总人数中的比重得到控制;第二,青少年犯罪人数不断增加。青少年犯罪呈现四个基本特点:第一,犯罪人员低龄化;第二,团伙犯罪日趋严重;第三,暴力化趋势明显;第四,犯罪手段智能化。第二章在分析现状的基础上论述犯罪亚文化是青少年犯罪的重要诱因。在这部分中,笔者分为三个层次进行论述:首先对亚文化与犯罪亚文化的概念进行界定;其次分析犯罪亚文化在原因系统中的定位,认为犯罪亚文化在引发青少年犯罪的众多因素中起到中介作用,是诱发青少年犯罪的直接原因;最后阐释犯罪亚文化诱发青少年犯罪的作用原理。第三章介绍了四种典型的犯罪亚文化以及由其引起的相关青少年犯罪,包括:暴力亚文化与青少年暴力犯罪、色情亚文化与青少年性犯罪、团伙亚文化与青少年团伙犯罪、网络犯罪亚文化与青少年犯罪。第四章通过对犯罪亚文化的研究,提出预防青少年犯罪的对策。从各种犯罪亚文化共同作用机理来看,可以把加强文化监管和加强青少年教育两个方面做为预防青少年犯罪的总体路径。虽然各类犯罪亚文化有相同的作用机理,但是不同类型的犯罪亚文化有其自身的特点。从暴力亚文化、色情亚文化、团伙亚文化和网络亚文化四种典型的犯罪亚文化各自特点出发,提出预防青少年暴力犯罪、性犯罪、团伙犯罪和网络犯罪的具体路径。
[Abstract]:There are closely related to culture and crime. Culture into the mainstream culture and the subculture, subculture and especially influence crime criminal subculture for teenagers. In recent years, although the height of juvenile crime attaches great importance to the theory and practice, but from a master data, the number of juvenile delinquency China is still showing a rising trend year by year. In general, juvenile crime and other criminal phenomena, natural causes, social causes, the comprehensive effect of individual reason and cultural reasons. But the criminal subculture is one of the causes of juvenile delinquency, leading to juvenile delinquency plays a role should not be overlooked. This paper focuses on the criminal subculture with juvenile delinquency this proposition, this paper is divided into four parts.
The first chapter is a general use of the data analysis of juvenile delinquency in China and the basic characteristics of juvenile delinquency in China. At present, presents two basic situation: first, the proportion in the total number of juvenile crime in the control; second, increasing the number of juvenile crimes. Juvenile crime shows four basic characteristics: 1. Crime younger age; second, gang crime is increasingly serious; third, violence tendency is obvious; fourth, intelligent criminal means.
The second chapter based on the analysis of current situation of criminal subculture is an important cause of juvenile crime. In this part, the author divided into three levels: firstly the concept of sub culture and sub culture of crime definition; secondly analysis of criminal subculture in the system, think to criminal subculture intermediary role in many factors causing juvenile delinquency, is the direct cause of juvenile crime; principle of final interpretation of the criminal subculture of juvenile delinquency.
The third chapter introduces four typical criminal subculture and caused by the relevant juvenile crime, including violent subculture and youth violence, pornography subculture and juvenile crime, gang subculture and youth gang crime, cyber crime subculture and juvenile delinquency.
The fourth chapter through the research on the criminal subculture, put forward measures to prevent juvenile delinquency. From the criminal subculture, interaction mechanism, can strengthen cultural regulation and general path for juvenile crime prevention to strengthen the two aspects of youth education. Although various types of crime subculture had the same mechanism, but the criminal subculture different types have their own characteristics. From the subculture of violence, pornography, subculture, subculture of gangs and network sub culture of four kinds of typical criminal subculture characteristics, puts forward the prevention of adolescent violence crime, crime, the specific path of gang crime and cyber crime.
