控制高科技犯罪的技术合理性反思

【摘要】：高科技应用巨大的社会效应,使其“双刃剑”功能更加凸显。一方面高科技的发展给人类带来物质财富的增长和生活的便利。另一方面,高科技在社会应用中的负效应也伴随其中。高科技犯罪就是高科技应用社会负效应的一种极端形式。犯罪分子利用高科技手段威胁社会的秩序,破坏人类的生活体系。当代需要通过公安系统的高科技化来弱化高科技犯罪对社会的影响。公安系统的高科技化是从技术上制约高科技犯罪的主要方式之一,也是杜绝和减少高科技犯罪的社会影响的最后屏障。公安系统的高科技化对公安系统中高科技刑侦手段的控制人员提出了更高的要求。因为高科技操作的不当,同样会带来诸如侵犯个人隐私等,对公民民主权利的侵害。如何界定公安高科技使用的尺度,在维护公共安全和维护社会成员利益最大化之间保持一种平衡,是本文探讨的重要内容之一。在处理两者的关系中,坚持人本主义原则,维护社会利益的最大化,反对技术主义是其中最重要的标准。公安高科技应用合理性标准的实施,最终需要通过高素质的公安人员来实现。我国现在公安人员素质与高技术条件下的办案要求还不完全适应。建立科学用人机制、培养机制,是建立高素质公安队伍的关键。
[Abstract]:The huge social effect of the application of high technology makes its "double-edged sword" function more prominent. On the one hand, the development of high technology brings the growth of material wealth and the convenience of living. On the other hand, the development of high technology brings about the growth of material wealth and the convenience of living. High-tech crime is an extreme form of high-tech application of social negative effects. Criminals use high-tech means to threaten the social order. It is necessary to weaken the influence of high-tech crime on the society through the high-tech of the public security system. The high-tech of the public security system is one of the main ways to restrict the high-tech crime from the technical point of view. It is also the last barrier to prevent and reduce the social impact of high-tech crime. The high technology of the public security system puts forward higher requirements to the control personnel of the high-tech criminal investigation means in the public security system, because the improper operation of the high technology will also bring about such as invasion of personal privacy and so on. How to define the scale of the use of high technology in public security and maintain a balance between maintaining public safety and maximizing the interests of social members. In dealing with the relationship between the two, it is the most important standard to adhere to the principle of humanism and to safeguard the maximization of social benefits. The implementation of the rationality standard for the application of high technology in public security. In the end, it needs to be realized by high-quality public security personnel. The quality of public security personnel and the requirements of handling cases under the high-tech conditions are not fully adapted in our country. The establishment of scientific employment mechanism, training mechanism. It is the key to establish a high-quality public security team.
