关于法人犯罪及其防范问题的研究

【摘要】： 法人犯罪，是人类社会商品经济和市场经济发展到一定历史阶段的产物，它作为一种区别于自然人犯罪的特殊犯罪类型，已成为现代社会面临的严峻问题。为维护社会政治经济秩序，世界各国纷纷制定了惩治法人犯罪的刑事法律。在当今世界，运用刑法手段惩治法人犯罪，已成为当代法制改革的一大趋势。近年来，随着改革开放的深入和社会主义市场经济体制的建立，法人犯罪呈蔓延之势，严重破坏了我国经济秩序和社会生活秩序，具有相当大的社会危害性。为了适应惩治和预防法人犯罪的需要，对法人犯罪及其防范问题进行研究，，不仅十分必要，而且相当迫切。本文在界定法人犯罪概念的基础上，剖析了法人犯罪的根源，通过对法人犯罪的学理概述，理性把握了法人犯罪，并着重从防范理念的构建出发，提出了法人犯罪防范的客观的宏观、微观对策。本文对产生法人犯罪的成因及其犯罪构成进行了深入的思考，对中外法人犯罪的理论和实践问题进行了较为全面的介绍，提出了法人犯罪防范的对策，具有很强的理论价值和现实意义。
[Abstract]:The crime of legal person is the product of the development of commodity economy and market economy of human society to a certain historical stage. As a special type of crime, it is different from that of natural person. In order to maintain the social, political and economic order, countries all over the world have formulated criminal laws to punish the crimes of legal persons. In today's world, criminal law is used to punish crimes committed by legal persons. Has become a major trend of the contemporary legal system reform. In recent years, with the deepening of reform and opening up and the establishment of a socialist market economy system, the crime of legal persons is spreading, seriously undermining the economic order and social order of life in China. In order to adapt to the need of punishing and preventing the crime of legal person, it is necessary and urgent to study the crime of legal person and its prevention. On the basis of defining the concept of the crime of legal person, this paper analyzes the root of the crime of legal person, by summarizing the theory of crime of legal person, rationally grasping the crime of legal person, and focusing on the construction of the concept of prevention. This paper puts forward the objective macro and micro countermeasures to prevent the crime of legal person. This paper makes a deep thinking on the causes of the crime of legal person and the constitution of the crime, and introduces the theory and practice of the crime of legal person in China and abroad. It has strong theoretical value and practical significance to put forward the countermeasures of legal person crime prevention.
