【摘要】： 经济犯罪是经济发展的产物，只要有一定的经济关系存在，就有经济犯罪产生的土壤。中国改革开放的20年，是经济飞速发展、社会主义市场经济体制从形成到确立的20年，是经济飞速发展、人民的物质、文化生活水平有了质的飞跃的20年，然而，犯罪类型逐年增多，并呈现出知识型、智能化的特征。信用卡诈骗犯罪就是其中的一种新型犯罪。其对市场秩序的巨大破坏性，以及近年来案件数量的激增趋势，已经引起社会各界的高度重视。本文拟就信用卡诈骗罪的犯罪定性，罪与非罪，，信用卡诈骗犯罪的特点和新趋势作一分析，并且结合信用卡诈骗自身特点对信用卡诈骗案件的侦查、防范对策作一深入探讨。第一章：首先对信用卡诈骗犯罪的概念及其构成进行界定和分析，随后对信用卡透支中的恶意透支与善意透支进行区别，这就从刑法学的角度对信用卡诈骗犯罪的罪与非罪进行了界定，使信用卡诈骗案件的构成要件更加清晰，同时对信用卡诈骗犯罪的社会危害性进行了阐述。第二章：主要阐明了信用卡诈骗犯罪的特点以及其犯罪新趋势，对侦查措施、手段、犯罪证据的收集进行了论述。其中，针对两种不同的信用卡诈骗方式：1、使用伪造、作废的信用卡及冒用他人信用卡诈骗；2、恶意透支，提出了不同的侦查方式和途径。第三章：结合侦查中的实际情况，总结打击、预防信用卡诈骗犯罪的经验，对信用卡诈骗犯罪的防范问题作一研究。在结论部分，就整篇论文做出总结，阐述主要观点。
[Abstract]:Economic crime is the product of economic development. As long as there is a certain economic relationship, there is a soil for the emergence of economic crime.Twenty years of reform and opening up in China have witnessed the rapid development of the economy, and the socialist market economic system has been developed for 20 years from the formation to the establishment of the socialist market economic system. It is 20 years since the rapid development of the economy and the material and cultural living standards of the people. However, the types of crimes have increased year by year and have shown a knowledge-based type. The characteristics of intelligence. Credit card fraud is one of the new types of crime. It is a huge damage to the market order, and the number of cases has increased in recent years. This paper intends to make an analysis of the criminal nature, crime and non-crime, the characteristics and new trends of the credit card fraud crime. Combined with the characteristics of credit card fraud, the investigation of credit card fraud cases, preventive measures to make a thorough discussion. Chapter one: firstly, the concept and composition of credit card fraud crime are defined and analyzed, and then the difference between malicious overdraft and bona fide overdraft in credit card overdraft is made. This paper defines the crime and non-crime of credit card fraud from the angle of criminal law, makes the constitutive elements of credit card fraud more clear, and expounds the social harmfulness of credit card fraud crime. Chapter two: mainly expounds the characteristics of credit card fraud and its new crime trend, discusses the investigation measures, means, and the collection of evidence of crime. Among them, forgery is used for two different credit card fraud ways: 1. Invalid credit cards and fraudulent use of other people's credit cards, malicious overdraft, put forward different ways and means of investigation. Chapter three: combining the actual situation in investigation, summing up the experience of cracking down and preventing the crime of credit card fraud, and making a study on the prevention of the crime of credit card fraud. In the conclusion part, the author summarizes the whole paper and expounds the main points.
